I am an enterprise specializing in Southeast Asian entrepot trade. I currently have a batch of Malaysian-made automotive electronic components stored in a public warehouse in Singapore. Originally, they were all transshipped to European and American markets. Recently, I received purchase orders from three domestic new energy vehicle manufacturers and want to directly import this batch of transit goods into China. I have never handled this type of business before and am unsure whether goods under the entrepot trade mode can be declared for import into China, or if they will be detained by customs as non-compliant goods with unknown origins.

Additionally, partial payment for this batch of goods has already been received through an offshore account. If I proceed with import, how do I reconcile the foreign exchange accounts? Can I enjoy the ASEAN agreement tariff rate? Are there any operational pitfalls to watch out for? Please provide a clear practical guide.

Goods under the entrepot trade mode can definitely be legally declared for import into China. The core is to ensure the logical verification of full-chain documents and avoid process discontinuities. In the preliminary review stage, complete entrepot full-chain documents must be prepared, including the Certificate of Origin issued by the official authority of the country of origin, continuous storage proof issued by the transit storage institution, full logistics bill of lading, and title transfer vouchers. It is necessary to ensure that the title transfer logic of all documents is a closed loop, and there are no conflicts in time and entity information, otherwise,it will trigger customs document review warnings, leading to direct rejection or even detention of goods.

In the core operation node connection stage, the declaration mode can be selected according to the subsequent cargo flow: if the goods finally enter the domestic market for sale, general trade import declaration can be used. ASEAN-origin goods that comply with RCEP rules of origin can directly apply for the applicable agreement tariff rate, enjoying up to zero tariff,if part of the goods needs to continue to be transshipped to other countries, they can be declared into a bonded supervision warehouse first. When leaving the warehouse, import tax payment or re-export procedures can be handled separately according to the flow, without paying import-stage taxes in advance.

Exception response plans need to be prepared in advance. If customs questions the valuation, submit the full procurement contract, storage fee vouchers, transit logistics bills, and other materials to prove the authenticity of the cargo value immediately, and the valuation review can be completed within 3 working days. At the level of foreign exchange settlement, the deposit received through the offshore account can be taken to the domestic bank for background verification with the full set of trade documents, and the exchange settlement and transfer can be handled directly without remitting payment abroad again, and there will be no conflict in the logic of receipt and payment. Under the premise of full-process compliance, the overall customs clearance efficiency is 1-2 working days faster than ordinary imports.

For entrepot trade import declaration, priority attention must be paid to the validity of the Certificate of Origin. If the goods have undergone simple processing or repackaging in the transit location, the origin qualification needs to be redetermined, and goods not meeting RCEP origin standards cannot apply the agreement tariff rate. When declaring, the previous entrepot declaration number must be filled in the "Associated Declaration" column of the customs declaration form. Failure to fill in as required will trigger logic verification exceptions, resulting in automatic system rejection.

If the Certificate of Origin information comparison does not match, the non-processing proof issued by the transit customs can be submitted, and the exception verification can be completed within 1 working day without deleting and re-declaring. In the valuation stage, attention must be paid to the storage and logistics costs generated during the transit stage, which must be included in the customs value. Failure to declare actively will result in customs recovering the tax and imposing a fine, and the fine ratio can reach up to 50% of the underpaid tax.

The logistics path for entrepot trade import can prioritize the route from Singapore direct to China ports. In 2026, the shipping space for Southeast Asia direct to domestic ports is sufficient, and the overall transportation time is only 3-5 days, saving more than 2 days compared with the transit via Hong Kong mode, and the logistics cost per container can be reduced by 1200-1800 yuan. When booking, the words "Entrepot Trade Entry" must be marked in the "Cargo Description" column of the bill of lading to avoid the shipping company charging extra document exchange fees as ordinary imported goods.

If the goods have container unpacking and consolidation operations in the transit location, the packing list and unpacking proof must be obtained in advance to avoid being asked to unpack and check after arrival, generating extra demurrage and detention charges. You can apply for an additional 7 days of free detention period from the shipping company to further reduce port expenses.

The tax calculation for entrepot trade import needs to distinguish the final flow of goods. For those directly entering the domestic market for sale, the value-added tax paid at the import stage can be deducted as input tax, and there is no need to transfer out input tax.

If the goods enter the bonded warehouse first and then are re-exported, there is no need to pay import-stage value-added tax and consumption tax, only storage fees need to be paid. For the cross-border profits generated by entrepot trade, the profit range can be reasonably adjusted through transfer pricing.

As long as the pricing range is within ±10% of the industry fair value, it will not trigger anti-avoidance investigations. For the income from entrepot trade obtained by non-resident enterprises, if no permanent establishment is established in the territory, there is no need to pay non-resident enterprise withholding tax, and the profits can be retained in the offshore account directly.

The receipt and payment of foreign exchange for entrepot trade import need to ensure the consistency of logistics flow, fund flow, and document flow. The payment received in the offshore account needs to provide a full set of trade documents to the domestic bank for authenticity verification. After approval, it can be transferred directly to the domestic basic account, and there is no need to handle filing for foreign currency payment under service trade.

If using RMB settlement, cross-border transfer can be handled through the CIPS system, and the arrival time is 2-3 working days faster than the SWIFT system, and the exchange cost can be reduced by 0.15%-0.2%. It should be noted that the foreign exchange collection data of entrepot trade needs to be uploaded to the SAFE digital foreign exchange management platform synchronously. Failure to upload as required will be listed as a key monitoring enterprise by the foreign exchange bureau, affecting the handling of subsequent receipt and payment business.

For entrepot trade import, the title transfer clause must be agreed in the contract in advance to clarify the ownership of the goods from the transit location to the domestic port, avoiding title disputes. If using Letter of Credit settlement, pay attention to deleting the "soft clauses" in the Letter of Credit. For example, if it is required to provide the non-processing proof issued by the transit customs as a negotiation condition, you can ask the issuing party to modify the clause, otherwise there will be a risk of refusal to pay.

The contract needs to add a force majeure fallback clause to clarify the responsibility division when the transit port encounters port congestion, strikes, etc., to avoid bearing additional breach losses. For goods involving intellectual property rights, confirm in advance whether there are relevant intellectual property rights filings in the country to avoid infringement and detention.

If the goods imported by entrepot trade are selected for inspection after arrival at the port, the original documents of the whole entrepot process must be prepared in advance, including the certificate of origin, transit storage proof, logistics bill of lading, etc., and submitted to the customs officer on site for verification. If the goods have changed packaging in the transit location, the origin information must be marked on the packaging in advance.

Those not marked with the origin will be required to rectify, and the port storage fees generated during the rectification period shall be borne by the cargo owner. When unpacking for inspection, ensure that the batch and quantity of the goods are consistent with the declared information.

If the quantity error is within ±5%, it can be explained and released directly. If it exceeds the range, the declared information needs to be modified. When passing through the X-ray inspection, inform the internal structure of the goods in advance to avoid misjudgment of suspected prohibited goods and speed up the inspection efficiency.

If the goods imported by entrepot trade are subsequently exported again, the full set of import declaration forms, tax payment vouchers, domestic procurement contracts, and other documents must be retained. Those meeting the requirements of consistency of the four flows can normally apply for export tax rebates, and the refund rate is consistent with ordinary goods export.

If the imported goods are used for domestic sales, the import duty and consumption tax must be included in the cost of goods, and the value-added tax is deducted as input tax, and there is no need to declare export tax rebate. It should be noted that the documents of entrepot trade need to be retained for at least 10 years for tax department audits.

Failure to retain documents as required will result in the recovery of the deducted input tax and corresponding fines. Foreign exchange verification must be completed within 180 days after import. Failure to complete on time will affect subsequent export tax rebate qualifications.
