I am a small and micro enterprise engaging in Southeast Asian entrepot trade. This year, we have just expanded our entrepot business to an annual revenue of RMB 50 million. Recently, during the annual fiscal and tax annual audit, the assigned accountant raised the issue of work safety production fund accrual.

I have been in the entrepot trade business for nearly 5 years and have never accrued such funds before. Now I am very worried, fearing that omission of accrual will trigger tax authority inspection, affecting our tax credit.

If we mistakenly accrue, it will unnecessarily increase corporate operating costs and crowd out working capital. The annual final settlement of corporate income tax is approaching, and we urgently need to clarify whether work safety production funds are required for entrepot trade and what the relevant compliance requirements are.

There are two common misunderstandings in the industry regarding work safety production fund accrual for entrepot trade: one is that all entrepot trade does not involve domestic production operations and is not required to accrue such funds, the other is that to meet compliance requirements, enterprises accrue regardless of business attributes, which unnecessarily increases corporate operating costs. Both improper operations will cause risks of varying degrees.

If the entrepot trade involves domestic transit warehousing and temporary processing links, omission of work safety production fund accrual will be included in the tax authority's verification scope, requiring tax adjustment, not only resulting in late payment penalties but also reducing the enterprise's tax credit rating, affecting the subsequent customs clearance and tax refund procedures for import and export business. If it is pure third-party entrepot trade with no physical operation links in China, incorrect accrual of work safety production funds will falsely increase corporate costs,be deemed as illegal pre-tax deductions, and in serious cases, trigger tax authority inspection, even affecting the annual inspection of import and export operation qualifications.

The core means of risk isolation is to first sort out the complete operation chain of one's own entrepot trade and confirm whether it involves domestic physical operation links. Entrepot trade with purely overseas transactions and no domestic operations are not required to accrue work safety production funds, entrepot trade involving domestic transit warehousing operations shall accrue based on actual revenue proportion.

For incorrect accrual or omission that has already occurred, the exclusive loss-stopping tip is to voluntarily apply for adjustment with the tax authority during the current year's final settlement period. As long as the adjustment is in place,it will not trigger administrative penalties or have a lasting impact on the enterprise's credit.

The accrual of work safety production funds for entrepot trade does not directly affect customs valuation, but if there are tax anomalies caused by incorrect accrual, it will be synchronized to the customs credit system, further affecting the customs clearance valuation process of entrepot trade. If the enterprise's tax credit rating declines, the customs will list the enterprise as a key verification subject, the valuation cycle of entrepot goods will be prolonged, valuation disputes may easily occur, customs clearance time will be extended, and additional demurrage charges will be generated.

For entrepot trade enterprises with tax anomalies, they need to timely provide cargo title transfer documents, transaction contracts, payment and collection vouchers, prove the authenticity of business, synchronously update corporate credit information, and quickly lift the customs' key verification status to ensure the normal circulation of entrepot business.

For entrepot trade involving temporary warehousing at transit ports, it is necessary to distinguish between domestic transit ports and overseas transit ports. Entrepot trade involving only overseas transit has all operation links overseas and does not need to accrue corresponding work safety production funds. If goods need to enter bonded warehousing at domestic transit ports for unpacking and container re-stuffing operations, the domestic warehouse operator will require the enterprise to allocate corresponding work safety production funds.

The enterprise shall record the actual allocated amount as expenses without additional separate accrual. In addition, the safety risks during container re-stuffing operations of entrepot trade need to clarify liability divisions with the warehouse operator in advance, avoid liability disputes caused by safety incidents, and avoid additional costs for the enterprise.

According to the current pre-tax deduction policies for corporate income tax in 2026, only work safety production expenses related to the enterprise's production and operation activities can be accrued and deducted before tax. Pure entrepot trade is purely a trading transaction without actual production operation links, so the corresponding work safety production funds accrual is not allowed to be deducted before tax, and if it has been accrued, tax adjustment for increase is required.

For entrepot trade involving domestic transit operations, the accrued work safety production funds that do not exceed the specified standard can be deducted before tax, and the excess part needs to be adjusted for increase. When bookkeeping, enterprises need to separately account for the operation links of entrepot business, distinguish expense standards for different businesses, and avoid tax risks caused by mixed accounting.

The accrual of work safety production funds for entrepot trade does not directly affect the compliance of cross-border payments and receipts, but if the profit is distorted due to incorrect accrual, it will affect the authenticity verification of the trade background by the State Administration of Foreign Exchange (SAFE).

When the scale of entrepot trade payments and receipts is large, and the profit after incorrect accrual is much lower than the reasonable range, SAFE will initiate verification of the transaction background, require the enterprise to provide relevant supporting materials, and delay the processing timeliness of payments and receipts. When filing for payments and receipts, enterprises need to truthfully declare the situation of expense recording, clearly distinguish the types of entrepot business, and avoid triggering compliance alerts due to distorted data.

Entrepot trade involves multiple transfers of cargo title, and the liability of work safety production funds accrual needs to be clearly defined in the transaction contract. If goods need to pass through a third-party transit, the liability of work safety shall be clearly defined in the contract, and the corresponding obligation of work safety production funds accrual shall be transferred accordingly.

If the contract stipulates that the transit party shall bear the safety liability, the enterprise does not need to accrue corresponding funds additionally, only record the safety fees collected by the transit party as transaction costs. If the liability is not clearly defined, the enterprise shall bear joint and several liability when a safety incident occurs, and also supplement accrual of corresponding work safety production funds, resulting in additional costs. Therefore, it is necessary to clearly define liability clauses when signing contracts.

Entrepot trade generally does not involve export tax refund, but incorrect accrual or omission of work safety production funds will affect the overall tax compliance of the enterprise, further triggering verification letters for export tax refund business. If the enterprise engages in both general trade export and entrepot trade, tax anomalies in the entrepot business will cause the whole to be listed as a verification subject, the audit cycle of export tax refund will be prolonged, affecting the enterprise's capital flow.

Enterprises need to separate accounting for entrepot business and general export business, record costs separately, and clearly define the funds accrual of different businesses to avoid mixed accounting affecting the normal handling of export tax refund. For enterprises that have already triggered verification letters, they need to timely provide complete documents of entrepot business to prove the compliance of accrual operations.

The accrual of work safety production funds for entrepot trade needs to be included in the overall supply chain cost accounting, and adjust the cost structure according to the operation mode of entrepot business. For pure entrepot business, exemption from accrual can reduce operating costs and improve profit margins. For business involving domestic transit, reasonable accrual of work safety production funds can optimize tax burden and reduce corporate income tax payments.

When designing the entrepot supply chain path, enterprises can select appropriate transit locations according to the rules of work safety production funds accrual to optimize the cost structure. For example, placing transit links at overseas ports eliminates the need to accrue domestic work safety production funds and reduces overall operating costs.

When entrepot trade undergoes customs inspection at domestic transit ports, the situation of work safety production funds accrual will not be used as a verification content for on-site inspection. However, if there are tax anomalies caused by illegal expense recording of work safety production funds, it will be synchronized to the customs inspection department, and the authenticity of the trade background of goods will be the key verification content during inspection.

Enterprises need to prepare complete documents of entrepot trade in advance, including transaction contracts, title documents, payment and collection slips, prove the authenticity of business, and cooperate with on-site inspection work. As long as the business is real, it will not affect the normal release of goods. If key inspection is triggered due to work safety production funds issues, providing tax adjustment certificates in a timely manner can quickly solve the problem.
