We are a small and medium-sized manufacturing enterprise engaged in household goods. We just obtained self-operated import and export rights this year, and used to only take domestic orders. Recently we received two batches of orders from the United States and plan to export by ourselves, but we do not have a dedicated tax refund operation post.

We consulted friends before and were told that it is very easy to make mistakes when handling tax refunds on our own. A peer told us that their tax refund was delayed for more than three months due to incomplete documents, and they were almost identified as non-compliant.

Our capital turnover is already tight now, so we want to entrust an export agency company to handle the tax refund. We would like to know how the export agency company operates the tax refund specifically, what we need to cooperate with, whether we can get the tax refund on time, and what risks we need to pay attention to in advance.

The tax refund handling work of export agencies is divided into four core links according to the full-link process, with clear operation standards for each step.

The first step is pre-document review. The entrusting party needs to provide basic materials such as special VAT invoices, electronic information of export goods declaration forms, export sales contracts, and foreign exchange receipt vouchers. The export agency will first verify that the quantity of goods stated on the invoice is consistent with that on the customs declaration form, and check common problems such as mismatched product names and units in advance to avoid declaration rejection.

The second step is core node connection. After completing the pre-declaration verification, the agency will submit a formal tax refund application within the declaration period, and follow up the review process of the tax authority simultaneously. Once receiving the correspondence verification notice,it will sort out and submit the corresponding materials as soon as possible to avoid affecting the review progress due to delayed submission of materials.

The third step is exception response plan. For common problems such as incorrect customs declaration information,out-of-control invoices, and abnormal correspondence verification, alternative supplementary certificate paths are prepared in advance. If there is an information entry error, the order deletion and re-declaration or data correction will be completed within 3 working days. If there is a doubt in correspondence verification, complete transaction authenticity certification materials will be prepared as required.

The last step is compliance implementation. After the tax refund review is passed, the tax refund will be transferred according to the agreed path, and the agency will complete the document filing and archiving simultaneously, with the retention period meeting the policy-required 10-year storage period to cope with subsequent tax inspections. For the entrusting party,it only needs to provide true and complete transaction materials in a timely manner as required and cooperate with necessary explanations, and there is no need to configure a dedicated tax refund post. Under normal circumstances of the whole process, the tax refund can be credited to the account within 1-3 months, which is much faster than the operation cycle of most small and medium-sized enterprises handling it on their own.

The core requirement for tax refund handling is to meet the four-flow consistency verification standard, that is, the information of goods flow, invoice flow, capital flow and contract flow is completely matched. Inconsistent information in any link may trigger tax inspection. The entrusting party needs to ensure that the special VAT invoices provided are compliant and effective input invoices, and there shall be no abnormal situations such as false issuance and capital return.

After the agency completes the tax refund declaration, all documents shall be filed and archived as required, including transport documents of export goods, packing lists, export tax refund filing lists, etc. If the tax authority conducts on-site inspection, all materials shall be available for access at any time. For cross-year export business, the declaration shall be completed before the deadline of the April declaration period of the next year, and tax refund cannot be handled if it is overdue, which is a time node requirement easily ignored by many enterprises.

In the process of handling export tax refund, tax optimization can be carried out in combination with the actual situation of the enterprise. For eligible export businesses, VAT retained tax refund can be applied for to reasonably reduce the tax burden cost of the enterprise. If small and medium-sized enterprises have insufficient input tax, the tax refund amount can also be optimized through compliant structural adjustment to ensure that the enterprise can enjoy the full tax refund benefit.

It should be noted that the tax refund rates vary for different goods, so the tax refund rate shall be accurately checked according to the commodity code, to avoid incorrect calculation of the tax refund amount caused by wrong code classification, which brings unnecessary losses to the enterprise. If it involves export tax refund for cross-border taxable services, it shall also meet the corresponding cross-border tax compliance requirements, and shall not illegally apply the tax refund rules for goods export.

Export tax refund requires enterprises to complete foreign exchange receipt verification. All export goods must complete foreign exchange receipt as required. Businesses that meet the deemed foreign exchange receipt conditions need to provide corresponding supporting materials, and businesses that fail to complete foreign exchange receipt as required cannot handle tax refund. Now the RMB Cross-border Interbank Payment System (CIPS) has been widely popularized.

For export businesses settled in RMB, the synchronization speed of foreign exchange receipt information is faster, which can effectively shorten the tax refund review cycle. For the delay of payment by some customers, it is necessary to prepare an explanation of the foreign exchange receipt situation in advance and report to the tax authority in advance to avoid affecting the progress of the tax refund process. It is not allowed to receive foreign exchange through third-party personal accounts, which will be identified as abnormal capital flow and directly lead to the rejection of tax refund applications.

The customs declaration information used for export tax refund must be completely consistent with the information of the actual exported goods. The product name, specification, quantity and unit on the customs declaration form must be consistent with those on the VAT invoice. If the measurement unit on the customs declaration form is inconsistent with that on the invoice, a conversion explanation shall be provided in advance, otherwise the tax refund review will be affected.

If there is an error in the customs declaration information, it is necessary to apply to the customs for amendment in time, and the electronic information can be updated after the amendment is completed before continuing the tax refund declaration. Do not declare with wrong information, otherwise the review cycle will be extended, and even directly trigger inspection. Under the current national customs clearance integration policy, the customs declaration information of any port can be synchronized to the competent tax authority, and no additional paper circulation is required.

To entrust an export agency to handle tax refund, a formal entrustment agency agreement shall be signed, in which the rights and obligations related to tax refund shall be clarified, and the transfer time of tax refund and liability for breach of contract shall be agreed to avoid subsequent disputes. The agreement shall clarify the division of responsibilities for transaction authenticity.

The entrusting party shall be responsible for the authenticity of all transaction materials provided by itself, and the agency shall be responsible for the compliance of the operation process. Clear responsibilities of both parties can effectively reduce subsequent risks. If the export goods involve intellectual property rights, the intellectual property customs protection filing shall be completed in advance to avoid goods detention due to intellectual property disputes in the export process, which affects the progress of the tax refund process.

If the export goods are inspected by the customs on site, it is necessary to cooperate with the customs to complete the goods verification to ensure that the actual goods are consistent with the customs declaration information. If it is found that the goods information is inconsistent with the declaration during the inspection, the customs declaration form will be modified, which will affect the tax refund progress.

After the inspection is completed, it is necessary to confirm that the seal is intact, check the inspection record information is correct before signing. If there is any objection to the inspection result, a re-inspection application shall be submitted in time to avoid leaving wrong records that affect the subsequent tax refund. If the inspection requires sample testing, it is necessary to follow up the issuance progress of the identification report, and synchronize the report to the agency and the tax authority in time to avoid process stagnation.

Logistics transport documents for export goods are necessary materials for tax refund filing. It is necessary to ensure that the port of departure, port of destination and goods information on the transport document are consistent with those on the customs declaration form and the contract. The bill of lading information shall be accurate, and there shall be no wrong filling of goods information.

If the goods are transshipped, relevant supporting materials for transshipment shall be provided to ensure that the track of goods flow is traceable and meets the requirements of tax inspection. If there is a change of port or transshipment, it is necessary to update the transport document information in time and synchronize it to the tax refund operation end, to avoid affecting the filing due to inconsistent logistics information, which leads to the failure of tax refund review.

The time for tax refund declaration can be reasonably arranged according to the export order cycle of the enterprise to match the capital turnover rhythm of the enterprise and reduce capital occupation. For enterprises with long-term and stable export business, the supply chain process can be optimized, and the whole tax refund operation process can be outsourced, so that the enterprise does not need to configure a dedicated operation post, reducing the operating cost of the enterprise.

The export operation process can be adjusted in combination with the division of responsibilities under different trade terms to ensure that all documents related to tax refund can be collected and sorted on time, to avoid missing documents caused by unclear division of responsibilities under trade terms, which affects the tax refund progress and increases unnecessary time costs.
