I am the head of a small and medium-sized foreign trade enterprise operating outdoor home products in the Yangtze River Delta. We have just secured bulk orders for the EU market this year.

We used to only operate cross-border retail direct shipping businesses that do not involve tax refund, and this is the first time we have hired an agency to handle general trade export. Last week during communication, the agency said we need to declare tax refund on our own, but I heard from peers that some agencies can handle the declaration on behalf of the entrusting party.

I am worried about falling into pitfalls now, as wrong confirmation of the declaration subject may lead to failed tax refund and even tax inspection. I want to figure out who is the statutory tax refund declaration subject under the agency export model, what conditions the two declaration methods need to meet respectively, and what red lines must be avoided.

First, clarify the statutory rules: According to the current export tax refund management specifications in 2026,the declaration subject under the agency export model can be either of the two parties, and the core judgment basis is the qualifications of the entrusting party and the agency as well as prior agreement between the two parties. If the entrusting party is a general taxpayer that has completed export tax refund filing, the agency can issue the Certificate of Agency Export Goods, after which the entrusting party can initiate tax refund declaration on the electronic tax bureau independently. If the entrusting party does not have tax refund qualification,it can sign a tax-inclusive procurement agreement with the agency, treat the goods as sold to the agency, and the agency will act as the declaration subject to complete the tax refund process.

In the pre-audit stage, two core requirements need to be verified in advance: First, the two parties shall sign a formal agency export agreement, clearly specifying the responsible party for tax refund declaration, document transfer time limit, and matching requirements for foreign exchange receipt path, the agreement retention period shall not be less than 5 years,Second, check customs declaration information in advance, the domestic consignor and production and sales unit shall match the information of the agreed declaration subject,to avoid logical mismatch that leads to pre-approval rejection.

In the core node connection stage,if the entrusting party chooses to declare tax refund independently, the agency shall transfer documents including the agency export certificate, tax refund copy of the customs declaration form and packing list to the entrusting party within 7 working days after cargo customs clearance, the entrusting party shall complete tax refund declaration within 90 days after export,If the agency is selected as the declaration subject, the entrusting party shall issue the corresponding value-added tax special invoice and deliver it to the agency within 3 working days after cargo dispatch,to ensure full consistency between invoice and cargo information.

For abnormal response plans,if the declaration is rejected in pre-approval,the consistency of information on the customs declaration form, invoice and foreign exchange receipt voucher shall be checked immediately. If the rejection is caused by information filling error, correction and re-declaration can be completed within 2 working days. If it involves tax correspondence verification, both parties shall submit corresponding trade documents simultaneously to cooperate with the verification, those who fail to submit materials after the time limit without reasonable reasons will be disqualified from tax refund.

Customs declaration information filling is the core pre-requisite for tax refund declaration. Under the agency export model, the "domestic consignor" column of the customs declaration form shall be filled with the name of the agency, and the "production and sales unit" column shall be filled with the name of the entrusting party. If it is agreed that the agency will declare tax refund, the remark "Agency export tax refund declared by domestic consignor" shall be marked in the remark column of the customs declaration form, to avoid logical verification abnormalities during subsequent data interaction between customs and tax authorities.

If the customs declaration information is filled incorrectly, an application for form modification shall be initiated within 15 days after customs clearance. If the time limit is exceeded, a situation explanation and corresponding trade documents shall be submitted for manual review, and tax refund declaration shall be initiated only after the form modification is completed, to avoid rejection due to inconsistent documents.

The choice of agency export tax refund model can be adjusted according to the enterprise's tax burden situation. If the entrusting party has sufficient input tax retained for the current year, choosing independent tax refund declaration can directly offset the domestic sales tax payable and reduce the overall tax burden; If the entrusting party has insufficient input tax, choosing the agency to declare tax refund on its behalf can embed the tax refund link into the supply chain settlement process and shorten the capital return cycle.

Note that the tax accounting requirements under the two models are different: under the independent declaration model, the agency service fee shall be issued with a 6% value-added tax special invoice; under the agency declaration model, the service fee can be included in the goods value accounting to avoid abnormal input tax deduction.

The foreign exchange receipt path shall fully match the tax refund declaration subject. If the entrusting party declares tax refund independently, the foreign exchange receipt subject shall be the entrusting party, foreign exchange settlement shall be completed through the pending verification account, and the corresponding foreign exchange receipt voucher shall be retained for future reference after settlement; If the agency declares tax refund, the foreign exchange receipt subject shall be the agency, and the entrusting party shall not directly collect overseas payments, to avoid the compliance risk of inconsistency between the receipt and payment subject and the tax refund subject.

According to the current cross-border foreign exchange receipt and payment management requirements in 2026, foreign exchange receipt shall be completed within 180 days after export. If foreign exchange is not received after the time limit, extension filing shall be handled, otherwise tax refund cannot be processed.

Four-stream consistency verification shall be completed before tax refund declaration, that is, the contract stream, goods stream, invoice stream and capital stream shall fully correspond, and the goods name, quantity and amount specified in the agency export agreement, customs declaration form, value-added tax special invoice and foreign exchange receipt voucher shall fully match without deviation. If tax correspondence verification is involved, a full set of document filing materials shall be submitted within 10 working days, including procurement contracts, warehouse entry and exit vouchers, transportation documents, customs declaration forms, foreign exchange receipt vouchers, etc. Those with incomplete materials will have their tax refund suspended, and those with serious circumstances will be transferred to the inspection department for handling.

Rights and responsibilities related to tax refund shall be clearly specified in the agency export agreement, including clauses such as the responsible party for tax refund declaration, time limit for tax refund to be credited, liability for tax refund failure, and cooperation obligation for tax correspondence verification, to avoid subsequent disputes.

If tax refund loss is caused by the agency's delayed delivery of documents or wrong information filling, the entrusting party can require the agency to bear the corresponding compensation liability according to the agreement. The compensation calculation standard shall be clearly specified in the agreement, to avoid the situation where rights and responsibilities are unclear and accountability cannot be realized.

The choice of agency export tax refund model can be adjusted according to trade terms. If the transaction is concluded under FOB terms, the ocean freight is borne by the overseas buyer, the freight column of the customs declaration form is filled with 0, and the tax refund base is the FOB price of the goods; If the transaction is concluded under CIF terms, the ocean freight is borne by the domestic seller, and the ocean freight shall be deducted from the total price of the customs declaration form to calculate the tax refund base.

When choosing the agency to declare tax refund, logistics costs can be incorporated into the settlement process, and the agency can issue unified invoices to deduct input tax, further reducing the comprehensive cost of the enterprise.

Logistics documents are necessary materials for tax refund filing. For agency export business, a full set of transportation documents shall be retained, including the bill of lading and dispatch order for the domestic transportation section, the ocean bill of lading and air waybill for the international transportation section, and the transit manifest if transit is involved.

The goods name, quantity, consignor and consignee information on the transportation documents shall fully match the information on the customs declaration form. If there is information inconsistency, the logistics service provider shall be required to issue a situation explanation for future reference in advance, to avoid tax refund rejection due to missing logistics documents during subsequent tax verification.
