We are a trading company focusing on importing European maternal and infant products. Recently, we received a batch of infant formula imported from Rotterdam, the Netherlands, which was originally planned to be directly re-exported to Singapore.

However, the customs required us to distinguish the import customs clearance type during declaration. Our customs broker noted that if the shipment is recognized as part of entrepot trade, we can apply for temporary storage in a bonded warehouse, but we need to confirm in advance whether import customs clearance falls into the category of entrepot trade.

This batch of goods is worth around 2 million Euros and arrived at the port last week. The daily port detention fee reaches 12,000 Euros, and we are worried that misclassification will lead to extra fines or missing the VAT deferral window.

Import customs clearance and entrepot trade are concepts of different dimensions, which cannot be directly equated. From the perspective of legal definition, import customs clearance refers to the customs procedure where a single batch of goods completes entry declaration, pays taxes (or applies for special regulatory policies) and enters the domestic territory, entrepot trade refers to the trade mode that goods purchased from overseas are directly resold to a third country without processing, with the core feature of "both ends outside the domestic territory". The differences between the two are mainly reflected in four dimensions: 1. Integrity of logistics chain: Import customs clearance only needs to complete the single-stage declaration of "port of shipment - port of destination",entrepot trade requires connection of multi-stage flow of "port of shipment - transit port - port of destination",and the transit link usually involves bonded warehousing (such as Shanghai Waigaoqiao Free Trade Zone) or customs supervised warehouse. 2. Ownership of goods and capital flow: Entrepot trade requires an "offshore company" as the main body to hold the goods ownership, and foreign exchange collection needs to distinguish "entrepot revenue" (such as Hong Kong offshore account) and "import advance payment" (such as cross-border RMB settlement),import customs clearance is directly bound to the domestic importer's goods ownership, applying the "domestic consignee" mode. 3. Policy application scenarios: Entrepot trade can enjoy VAT deferral (such as transit within the EU) and temporary exemption of import tariff (subject to Article 31 of the Customs Law),while for import customs clearance under "general trade",13% value-added tax shall be paid as required (under the 2026 new policy, maternal and infant products may apply a low tax rate of 3%). 4. Differences in regulatory documents: Entrepot trade requires additional submission of Entrepot Trade Filing Form,International Transit Goods Customs Declaration Form, import customs clearance only requires basic documents such as Import Goods Declaration Form and Certificate of Origin.

In view of your practical scenario,it is recommended to avoid risks from three core nodes: 1. Dual-track pre-document review: Submit the Entrepot Trade Filing Letter (with transit country code and final port of destination clearly noted) before customs declaration. If the customs questions that the goods are not for entrepot trade, immediately supplement the Domestic Consignee Undertaking Letter to prove the usage. 2. Goods ownership locking at transit port: If the goods need to be transited via a third country,it is recommended to transfer the goods ownership to the "transit trading company" through CIF terms,to prevent the domestic importer from handling the customs declaration form for foreign exchange settlement prematurely. 3. Hierarchical response to abnormal plans: If the customs determines the shipment as "general trade",submit Supplementary Statement on Import Entrepot Trade within 5 working days, and apply for the exemption clause of "entrepot trade outside non-bonded zones" (the "15-day grace period" policy newly added by the General Administration of Customs in 2026).

Under the latest 2026 regulatory requirements, the compliance red line for import customs clearance of entrepot trade has been clarified: if the entrepot declaration is not completed within 30 days after the goods enter the territory, the risk of "unauthorized sales" will be triggered (corresponding to Article 18 of the Regulations on the Implementation of Customs Administrative Penalties). It is recommended that you prioritize the combined mode of "bonded warehouse + entrepot trade",and realize full-process closed loop through our Zhongshitong Entrepot Trade Service Package (including international logistics, customs pre-classification and foreign exchange balancing),which has successfully solved similar problems for more than 200 cross-border maternal and infant enterprises.

Chief Customs Declaration Expert: For import customs clearance of entrepot trade, extra attention shall be paid to the "secondary customs declaration" procedure. If "entrepot" is not clearly marked when declaring the goods, the customs may misjudge it as "direct import", which triggers full 13% value-added tax payment.

It is recommended to select "0 Entrepot Trade" in the "trade mode" column of the customs declaration form, and note "not for domestic consumption" in the remarks column.。

Senior Logistics Expert: The selection of transit port shall match the connection timeliness of "direct voyage / second leg vessel". For example, for the Rotterdam-Singapore route, you can use the newly launched "transit free storage period" service of COSCO SHIPPING in 2026, which extends the 15-day free storage period to 48 hours.

Meanwhile, the bill of lading shall be endorsed with "To Order of Transshipment Agent" to prevent the domestic consignee from locking the goods ownership in advance.。

Senior Tax Consultant: The 2026 VAT deferral policy allows enterprises engaged in entrepot trade to temporarily not pay VAT during import, as long as the Tax Guarantee Letter for Entrepot Trade is provided.

However, note that if the goods are unpacked and processed in the bonded warehouse, the deferral qualification will be lost. It is recommended to isolate processing risks through the "bonded warehouse + distribution center" mode.。

Trade Compliance Expert: For foreign exchange settlement, it is necessary to distinguish the "SWIFT message code". Entrepot trade revenue shall be declared as "121000 Entrepot Trade Revenue", to avoid misreporting as "101010 General Trade Revenue" which will trigger verification by the State Administration of Foreign Exchange during settlement.

It is recommended to use the Cross-border Interbank Payment System for cross-border payment, and the newly launched "special channel for entrepot trade" in 2026 can reduce the foreign exchange spread loss to less than 0.3%.。

Foreign Trade Legal Expert: It is necessary to sign the Exclusive Entrepot Trade Agreement to clarify the rights, responsibilities and obligations of the transit country supplier and the domestic agent, so as to avoid goods ownership disputes caused by "delivery of goods without bill of lading". The customs newly launched the "Entrepot Trade Letter of Guarantee" template in 2026, which can reduce the risk of fines ranging from 300,000 to 500,000 RMB caused by declaration errors.。

On-site Inspection Expert: If the goods are selected for inspection, prepare the Entrepot Trade Goods Flow Certificate in advance, which includes the full-link GPS track of "port of shipment - transit port - port of destination".

The 2026 inspection focuses on verifying the "consistency between certificate of origin and mark on bill of lading". It is recommended to use the dual mode of "machine inspection + manual inspection" to shorten the customs clearance time to within 48 hours.。

Special Packaging Engineer: If the goods are infant food (such as milk powder), it is necessary to confirm that the UN number packaging complies with the International Maritime Dangerous Goods Code 2026. Even if the goods are not dangerous goods, "food grade packaging" shall be marked, to avoid extra rectification fee of 5,000 RMB per time caused by packaging problems during customs detention.。
