I am a company specializing in semiconductor reexport trade. Recently, we have a batch of wafers (HS Code 8542) imported from Malaysia to be reexported to Germany. As planned, they were to be shipped to Shanghai Port first before transshipment customs clearance.

However, last week, the freight forwarder informed that such reexport goods cannot be directly entered into China, otherwise, customs will tax them as imported goods, leading to a skyrocketing cost. Currently, the goods have been detained in Yangshan Port Bonded Area for 3 days.

Clients are urging delivery daily, and the CFO stated that if taxed as imports, the VAT and tariff on this batch would eat up all profits. Can we allow the goods to enter China? How to prove they are for reexport rather than import after entry? Is there a way to avoid high taxes while completing reexport compliance?

The core to whether reexport trade goods can enter China is achieving compliance through "trade nature declaration" and "physical supervision isolation". A common industry misconception is that "reexport must not enter China" or "entry equals deemed import and tax",leading to two chained risks: first, goods not declared as reexport are taxed as imports, incurring double costs of 13% VAT + 8% tariff, second, detention beyond the free storage period (Shanghai Port extends free storage to 7 days in 2026) incurs port dwellage fees, accumulating 0.05% of cargo value daily, and customs withholding will be triggered if over 15 days.

The key to physical risk isolation is building a double closed loop of "bonded warehousing + transit transportation": goods must first enter a customs special supervision area (e.g。Yangshan Port Bonded Area) upon entry to avoid import tax through the "outside China within China" feature. When declaring, submit the "Reexport Trade Goods Entry Declaration",clearly mark "reexport trade" as the trade mode (Code 0139),and attach four consistent documents: overseas purchase contract, reexport sales contract, secondary export manifest, etc.

Stop-loss tips: ① Submit "Pre-classification Application" to the local customs 72 hours in advance, clearly define the wafer as "unprocessed" (classified as 85421000) to avoid valuation disputes,② During ownership transfer in the bonded area, generate electronic ownership certificate via a third-party logistics system (e.g。Zhongshitong "Global Warehouse & Distribution" platform),and synchronize with CIPS cross-border payment system for closed-loop fund flow,③ If inspected, prepare "Reexport Trade Customs Valuation Coordination Table" with the final sales confirmation from the German importer to prove the goods' final destination is outside China.

Chief Customs Declaration Expert: Reexport trade entry requires three document reviews: ① Declare "reexport" as trade mode (0139) and note "non-final destination goods" in remarks when declaring the manifest; ② Attach "Reexport Trade Goods Customs Declaration Form" (special format), select "Other Legal" (Code 996) in the "Duty Exemption Nature" field; ③ If customs questions valuation, apply for "pre-ruling" by submitting pre-import reexport sales contracts in third countries (e.g., Singapore) and international transport documents to prove no domestic processing value-added.。

Senior Logistics Expert: Logistics path should adopt "three-stage transshipment": ① Direct sailing from origin port to transit port (e.g., Singapore Port) to avoid manifest mismatch due to port change; ② Complete bill of lading "straight endorsement" at transit port (with "transfer upon Zhongshitong Logistics' instruction" in the consignee field) to ensure ownership transfer with logistics nodes; ③ Choose "transit customs clearance" (Code 0008) for entry, directly transfer from Yangshan Port Bonded Area to Pudong Airport Comprehensive Bonded Area.

Track container seal status via GPS throughout. New 2026 regulation requires transit time ≤90 days, with customs inspection automatically triggered if overdue.。

Senior Tax Advisor: Under 2026 cross-border tax new policies, reexport trade enjoys three benefits: ① Adopt "outside China within China" mode, apply for VAT "immediate refund" (need "Export Goods Tax Refund Certification"); ② Utilize "offshore resale" mode, related-party pricing must comply with "arm's length principle", i.e., import-export price spread controlled within 5%; ③ Avoid exchange loss via "non-resident individual proxy", use CIPS for cross-border payment to prevent SWIFT message interception due to "misclassified trade nature".。

Trade Compliance Expert: Three points for foreign exchange settlement: ① Note "Reexport Trade - Goods Resale" in bank remittance remarks to avoid misclassification as "general trade"; ② Adopt "offshore account - onshore account" dual management, with overseas payment first into HSBC Hong Kong offshore account, then remit via CIPS. 2026 SAFE requires "International Balance of Payments Declaration" for single transactions over $5 million; ③ Allowable payment difference ≤3%, retain difference explanation documents (e.g., international freight, insurance certificates).。

Foreign Trade Legal Expert: Sign "Reexport Trade Tripartite Agreement" to clarify responsibilities: ① Signatures from seller (Malaysian supplier), buyer (German importer), and our company (reexport trader); ② Include "customs policy change clause" stipulating no liability for policy-related reexport failure; ③ File IPR protection declaration at General Customs before entry; 2026 new "Semiconductor Chip IPR Green Channel" can shorten inspection time to within 4 hours.。

On-site Inspection Expert: Four preparations before inspection: ① Submit "Inspection Work Order" to customs 24 hours in advance, note "reexport" nature and final destination; ② For precision instruments like wafers, adopt "contactless inspection" (infrared scanning + X-ray penetration) to avoid physical unpacking damage; ③ If goods and documents mismatch, immediately start "urgent release" process, submit "Reexport Trade Goods Release Guarantee Letter" for temporary release, with materials completed within 72 hours.。
