I am a foreign trade practitioner engaged in transit trade between Southeast Asia. Recently, I received an order from Malaysia to the EU via transit.

The freight forwarder said a customs declaration form is required, but I remember that transit trade does not enter the territory. Why is a customs declaration form still needed?

If there is no such form, will the cargo be detained? Now the order is about to reach the transshipment port, and I urgently need to confirm whether it needs to be handled and how to operate specifically?

Whether a customs declaration form is required for transit trade depends on the supervision rules of the transshipment port and the scenario of cargo rights transfer, and is not a one-size-fits-all situation.

If the transshipment port is within the customs supervision area, and the cargo rights transfer or unpacking and sorting occurs at the transshipment port, the transit goods customs declaration form shall be submitted to the customs of the transshipment port. For cases where only simple container reloading is performed without cargo rights change, transshipment filing can be applied to exempt from formal customs declaration, but transshipment application materials shall be submitted to the customs in advance.

If not handled in accordance with the requirements, the customs of the transshipment port may detain the cargo on the grounds of "false declaration of cargo flow",resulting in demurrage charges, fines, and even affecting subsequent EU customs clearance. When operating,it is necessary to confirm the supervision requirements with the customs of the transshipment port in advance, retain documents such as the full set of bills of lading and cargo rights transfer agreements, and cooperate with the freight forwarder to complete the filing verification at the transshipment port.

In addition,by 2026,most transshipment ports worldwide have realized electronic declaration, and transshipment applications can be submitted through the single window without offline travel. It is recommended to complete the filing 72 hours in advance to avoid delaying the sailing schedule.

The demand for customs declaration forms for transit trade should be judged in combination with the customs supervision rules of the transshipment port. For transit transit trade, if the cargo is only reloaded at the transshipment port and no cargo rights transfer occurs, some ports only need to submit a transit filing list instead of a formal customs declaration form; if the cargo is unpacked, sorted or cargo rights changed at the transshipment port, a formal transit goods customs declaration form must be submitted.

It should be noted that the supervision requirements of transshipment ports in different countries are different, and it is necessary to confirm the specific rules with the local customs or professional agents in advance to avoid cargo detention due to document non-compliance.

The logistics path planning for transit trade needs to focus on the operation efficiency and compliance requirements of the transshipment port. When selecting a transshipment port, priority should be given to ports with transit filing green channels, which can significantly shorten the document review time.

At the same time, the bill of lading endorsement rules shall be clarified with the freight forwarder to ensure that the cargo rights documents match the customs declaration documents completely, and avoid inconsistencies between cargo rights and declaration information. In case of overbooking at the transshipment port or need to change ports, the customs declaration filing information shall be adjusted in time, and the cargo rights transfer agreement shall be updated synchronously to ensure full-chain cargo rights control.

The tax planning for transit trade needs to be designed in combination with the cargo rights transfer path. If transit trade does not involve the transfer of cargo rights within the territory, cross-border VAT deferral can be applied to avoid additional tax burdens at the transshipment port.

At the same time, attention should be paid to the compliance of related party transaction pricing to avoid tax authority inspections due to BEPS risks. For businesses involving EU transit, the EU's anti-tax avoidance rules shall be confirmed in advance to ensure that the tax structure meets the latest cross-border tax regulatory requirements by 2026, reducing tax compliance risks.

The compliance of foreign exchange receipt and payment for transit trade shall match the circulation logic of customs declaration documents. SWIFT or CIPS shall be used for cross-border foreign exchange transactions to ensure that the foreign exchange receiving entity is completely consistent with the shipper and consignee on the customs declaration form.

If offshore account operations are involved, account compliance filing shall be completed in advance to avoid bank rejection or customs letter inquiries due to inconsistent foreign exchange receipt and payment entities. At the same time, complete trade background materials shall be retained, including order contracts, bills of lading, cargo rights transfer agreements, etc., for subsequent tax or customs inspections.

The contract terms for transit trade shall clarify the division of document responsibilities. It shall be agreed in the contract that the freight forwarder shall provide the transshipment port filing certificate or customs declaration form copy, and clarify that the losses caused by missing documents shall be borne by the responsible party.

At the same time, force majeure clauses shall be added to cover document delays caused by changes in transshipment port customs policies. For large-value orders, an advance payment bond can be required to ensure fund security and avoid non-recovery of payment due to document issues.

On-site inspection at the transshipment port shall be prepared in advance with the matching of documents and cargo. If an inspection notice is received, the seal number shall be checked with the bill of lading information immediately to ensure that the cargo packaging meets the physical security requirements of the transshipment port.

If seal damage or inconsistencies between cargo and declaration information are found, the freight forwarder shall be contacted immediately to adjust the customs declaration documents to avoid cargo detention due to unqualified inspection. At the same time, the unpacking process of the transshipment port shall be familiar, and unpacking tools and personnel shall be prepared in advance to shorten the inspection time.

The cargo packaging for transit trade shall meet the dual compliance requirements of the transshipment port and the destination port. If the cargo is general goods, the packaging marks shall be clear and meet international maritime packaging standards; if the cargo is dangerous goods, UN packaging certification shall be completed in advance, MSDS reports shall be prepared and compliant labels shall be affixed.

At the same time, appropriate cushioning materials shall be selected according to the cargo characteristics to avoid cargo damage during container reloading at the transshipment port. It should be noted that by 2026, most transshipment ports have activated intelligent packaging verification systems, and non-compliant packaging will directly prevent cargo from entering the supervision area.

The export tax rebate for transit trade shall be judged whether it meets the declaration conditions in combination with the cargo rights transfer path. If transit trade does not involve the transfer of cargo rights within the territory and is not declared through domestic ports, it is impossible to enjoy the export tax rebate policy.

However, complete trade documents shall be retained, including order contracts, bills of lading, foreign exchange receipt and payment vouchers, etc., for subsequent document filing inspections by tax authorities. If domestic-purchased goods are used for transit trade, consistency of the four streams shall be ensured to avoid export tax rebate delays due to tax letter inquiries.

The supply chain structure for transit trade shall optimize the cost and efficiency of transit links. Logistics costs can be reduced by selecting direct transit routes, and cooperation with multiple freight forwarders can be established to deal with sudden cabin shortage issues.

Trade terms shall be adjusted according to cargo characteristics; for example, for high-value goods, CIF terms can be selected to control logistics and documents by our side, reducing cargo rights risks. At the same time, a supply chain risk early warning mechanism shall be established to real-time monitor policy changes and logistics dynamics at the transshipment port, and prepare response plans in advance.
