I am a trader of smart home products, with the United States as my main market. In 2026, the United States imposed additional high tariffs on some Chinese smart home products, which caused a serious decline in the competitiveness of my products.

I heard that through transshipment trade, for example, goods are shipped from China to Malaysia, containers are swapped before being sent to the United States, such tariffs can be evaded. But I am completely new to this model, and the most troublesome thing is how to find a reliable Malaysian partner?

I am worried that the counterparty is untrustworthy, which will lead to my goods being detained at the Malaysian port, or total loss of both funds and goods. I need a cooperation plan that can help me control full-process risks and ensure the safety of funds and goods.

Your question hits the core vital point of transshipment trade — risk control. Many enterprises step into traps at the first step, believing that finding the intermediary with the lowest quotation is everything. This kind of thinking will lead to cascading disasters: in order to reduce costs, the intermediary will use non-compliant "document packaging" services, the goods are detained and inspected by customs at the transshipment port, resulting in sky-high Demurrage & Detention fees, worse,if the intermediary has poor credit standing, your payment may be misappropriated,or even the counterparty loses contact, resulting in total loss of both funds and goods.

To isolate these risks,a physical firewall must be established. The primary principle is cargo ownership must be firmly held in your own hands. When shipping from China, the Consignee on the Bill of Lading (B/L) cannot be directly written as the final intermediary, but as your trusted agent at the transshipment port,or adopt the "To Order B/L" mode endorsed by your company. In this way,no one has the right to dispose of the goods without your explicit instruction before container swapping in Malaysia.

The second is capital flow segregation. Never pay a large sum of goods payment to an unfamiliar partner in one lump sum. You should adopt the mode of Letter of Credit (L/C) or third-party Escrow account custody, and strictly bind payment nodes with key actions (such as receiving compliant transshipment documents, goods departing from the port,etc.). This can greatly reduce the counterparty's incentive to breach the contract, and even if problems occur, the funds can be frozen in a secure account.

The last is authenticity control of document flow. A reliable partner must be able to provide a full set of documents such as certificate of origin, commercial invoice, packing list independently applied for in the transshipment country. You need to review the issuing authority and logical consistency of these documents, and match them with the logistics trajectory. Never accept intermediaries that provide "one-stop full service" but cannot provide evidence of document generation process. An effective verification method is to require the partner to provide the registration information of its local company, desensitized B/L and customs documents of similar goods operated in the past as reference for background check.

When risks occur, the loss mitigation tips are critical. Before cooperation, you should require the intermediary to sign the Letter of Indemnity (LOI) for cargo ownership transfer, clarifying its identity as your agent and liability for compensation for breach of contract. At the same time, purchase trade credit insurance for the entire transshipment process to transfer extreme risks to the insurance company. In terms of structure, always prepare a backup transshipment port and partner (such as Vietnam or Thailand),so that you can switch quickly once the main channel fails,to avoid supply chain disruption.

In transshipment trade, customs valuation is a high-frequency risk point. In 2026, global customs data linkage will be more closely coordinated, and the crackdown on "origin laundering" will be a key priority. If the partner only provides a proforma invoice with the goods value seriously deviating from the market price of similar products, it will easily trigger customs price queries.

Once it is determined as "false declaration of trade mode" or "price fraud", not only the goods will be detained, but also high fines or even criminal investigations will be faced. When selecting partners, it is necessary to assess their ability to respond to customs valuation, whether they can provide commercial invoices that meet the reasonable profit level of the transshipment country, and prepare a complete statement of cost composition to cope with possible inspections.

Logistics path design is inseparable from cargo ownership control. A professional partner should be able to provide a clear logistics plan: whether it is direct sailing to the transshipment port, or inland trailer transportation is required? Will the container swapping operation be carried out in a bonded warehouse or an ordinary warehouse? This is directly related to cost and time.

The key point lies in the connection of B/L. The consignee of the first-leg B/L from China to the transshipment port shall be controlled by you, and the shipper of the second-leg B/L (destination port B/L) issued after container swapping shall be displayed as the partner, but you need to ensure that you can get the original B/L or telex release instruction before paying the balance. Avoid using "straight B/L" to prevent cargo ownership from being transferred to others during transportation.

Transshipment trade involves cross-border tax linkages, improper structure design will lead to double taxation or anti-tax avoidance investigation. The tax identity of the partner's country (such as Malaysia) is very critical.

Ideally, the partner should be a tax resident enterprise with substantial business operations (such as owning warehouses and employees), that can issue invoices in compliance with local tax laws for you, and complete necessary tax declarations. This can effectively isolate the tax risks of Chinese companies, and avoid being recognized as constituting a Permanent Establishment (PE) in the transshipment country, or being challenged for Base Erosion and Profit Shifting (BEPS) behaviors.

Capital flow compliance is another major challenge. Your payment of goods is made to overseas partners, and the final customer makes payment to you, which easily leads to mismatch between "overseas collection and domestic shipment", affecting foreign exchange verification and tax refund.

The partner needs to assist in designing a compliant receipt and payment path. For example, conduct capital settlement through its offshore account in Hong Kong or Singapore, and ensure that the relevant commercial contracts, logistics documents and capital flows can correspond clearly, forming an evidence chain of "three flows in one" to meet the regulatory requirements of the State Administration of Foreign Exchange and the State Taxation Administration of China.

Legal agreements are the last line of defense for risk underwriting. In the Agency Agreement or Service Contract signed with the transshipment partner, it is necessary to clearly specify: service scope (container swapping, document preparation), rights and responsibilities of both parties, cost composition, payment conditions, liability for breach of contract (especially the liability for cargo ownership loss and document fraud), as well as applicable laws and dispute resolution locations (Hong Kong or Singapore arbitration is recommended).

Be sure to add a "compliance guarantee clause", requiring the partner to promise that all its operations and issued documents fully comply with the laws of the transshipment country and the destination country, otherwise it shall bear all losses and fines.

On-site customs inspection of goods at the transshipment port is a common scenario. The partner's on-site handling capacity with local customs is crucial. They need to be familiar with the local inspection process, respond quickly to inspection instructions, and know how to communicate effectively with inspection officers to explain the compliance of transshipment trade.

Especially for electronic products, customs may pay attention to whether the model, nameplate and internal components are consistent with the document declaration. The partner should have experience in handling such unpacking inspections to avoid unnecessary cargo detention or document modification caused by poor communication.

The compliance of goods packaging is often ignored. Smart home products may contain lithium batteries, which belong to Class 9 dangerous goods. For export from China and re-export from the transshipment country, it is necessary to provide MSDS (Material Safety Data Sheet) and dangerous goods packaging certificate (UN packaging certificate) that meet international standards.

The partner must have the ability to review the MSDS you provide, and ensure that the goods packaging complies with the IMDG Code (International Maritime Dangerous Goods Code) during the container swapping process, to avoid being rejected or fined at the destination port due to packaging problems.

The smooth processing of export tax refund depends on the completeness of the document chain. Under the transshipment trade mode, your company needs to handle tax refund with China's export customs declaration form, ocean B/L, etc. The overseas documents provided by the partner (such as transshipment country documents) are not directly used for tax refund, but they must logically corroborate with the domestic export documents in terms of product name, quantity and value, to prepare for possible verification letters from the tax authority.

The partner should cooperate to provide proof that it has received the goods as the consignee, to prove that the goods have actually left the territory, which is one of the key evidences for tax inspection.

From the overall supply chain perspective, selecting a transshipment partner is not only finding an operator, but also choosing a strategic node. It is necessary to evaluate the logistics timeliness brought by its geographical location, local warehousing cost, operation efficiency and buffering capacity for fluctuations in the final market.

An excellent partner can help you build a more flexible and resilient supply chain network, and control cost fluctuations within a measurable range against the background of high tariff barriers, rather than only completing a one-time transshipment task.
