We are a foreign trade company specializing in precision instrument exports. Recently we plan to transship a batch of semiconductor components from China to North Korea, but two agents we contacted both encountered bottlenecks. One failed the customs clearance due to incorrect HS code classification, while the other had port demurrage fees exceeding the budget during transit in Vietnam.

North Korea Customs suddenly updated its requirements for certificate of origin for third-country transshipment, and we also heard that some sensitive goods are restricted from transit. Now we are worried about both cargo rights being intercepted by third parties and funds being frozen. We want to know if there is a mature transshipment route?

For example, is transit through a third country mandatory? How to avoid HS code disputes in documents? Are there any more cost-effective logistics solutions? Most importantly, how to ensure compliance and avoid losses caused by sudden policy changes?

Transshipment trade to North Korea must take "full-link closed compliance loop" as the core, and be implemented in four steps:

1. Pre-document Dual Review Mechanism: Confirm in advance whether the target goods are included in North Korea's "Sensitive Commodity List" (semiconductors and medical equipment are newly added to the control list in 2026). If the goods are involved, apply for a third-country certificate of origin (such as issued by the UAE/Malaysia) in advance to ensure continuous and traceable origin. The HS code must match the "Revised Harmonized System" of the transit country. It is recommended to use the "advance ruling on commodity classification" system to lock the code first,so as to avoid port demurrage caused by classification disputes.

2. Dynamic Screening of Transit Nodes: Prioritize third countries along the Belt and Road (Vietnam,Kazakhstan) and avoid sanctioned sensitive countries. The logistics route adopts "dual-endorsement bill of lading" (original bill of lading + telex release bill of lading). When completing the "cargo right endorsement transfer" at the transit port,it must be filed with the local customs simultaneously. If the cargo weight exceeds 15 tons,it is recommended to choose the direct "Busan-Chongjin" shipping route (three sailings per week, the demurrage fee is only 60% of that of South Korean ports).

3. Multi-dimensional Emergency Plan for Exception Scenarios: In case of "wrong final destination declaration" (such as North Korea Customs misjudging the trade nature),start the "Four Flows Consistency" emergency verification: cross-check the pre-declaration data with the actual bill of lading, certificate of origin and foreign exchange receipt slip, and complete "cancellation and re-declaration" within 24 hours. For fund settlement, adopt the "CIPS RMB settlement channel" to avoid the additional review cycle of the SWIFT system.

4. Dynamic Adaptation of Policy Compliance: In 2026,North Korea's "Whitelist of Transshipment Trade Enterprises" newly added the "China-Russia Border Mutual Trade Zone". If the final destination of the goods includes China-Russia border ports, you can apply for the "inside the territory but outside the customs" mode to realize VAT deferral. However, please note that all transit documents must be certified by the North Korean embassy in the third country,to ensure that the data matches the domestic customs networking verification results.

Chief Customs Declaration Specialist: Special attention should be paid to the "origin marking" issue for transshipment to North Korea. Documents issued by the transit country must not contain the wording "Made in China", otherwise it may trigger the "third-country origin discrimination clause".

It is recommended to carry out "neutral packing" of the goods at the transit port (remove brand labels from the original packaging), and keep packaging change records for customs inspection.。

Senior Logistics Specialist: The "three-stage scheme" should be adopted for transshipment logistics to North Korea: China to transit port (FCL sea freight) → transit port to North Korea (railway/road transport) → final destination (multimodal transport). Haiphong Port in Vietnam is recommended as the transit hub, which has a free storage period of up to 14 days, and the "China-Vietnam Border Green Logistics Channel" can shorten the time efficiency by 30%.。

Senior Tax Consultant: Transshipment to North Korea can apply for "temporary tariff exemption", on the premise that the goods stay in the transit country for more than 90 days without substantial processing.

Please note North Korea's VAT withholding requirement for "offshore company transshipment". It is recommended to confirm the "non-resident enterprise withholding tax" rate with the local tax office in advance to avoid extra costs.。

Trade Compliance Specialist: Adopt "dual-currency settlement" (RMB + North Korean Won) for transshipment to North Korea to avoid the risk of single currency fluctuation. When collecting foreign exchange, remark "transshipment trade" in the CIPS system, and submit the "Special Trade Filing Form" to the State Administration of Foreign Exchange simultaneously, otherwise it may trigger "foreign exchange account freezing".。

Foreign Trade Legal Specialist: The "Force Majeure Clause" must be clearly specified in the transshipment agreement, listing "international sanction list update" as a triggering event. It is also recommended to purchase "export credit insurance" to cover cargo losses caused by sudden policy changes in North Korea, with the premium accounting for about 1.2%-1.8% of the cargo value.。

On-site Inspection Specialist: If the goods are inspected, the "third-party test report" (such as semiconductor purity test) must be submitted within 2 hours to avoid cargo detention caused by "inconsistent composition". Before inspection, download the "inspection notice template" from the official website of North Korea Customs to ensure all documents follow the unified format.。

Export Tax Rebate Auditor: For transshipment trade to North Korea, attention should be paid to the "four flows in one", that is, the contract flow, logistics flow, capital flow and document flow are fully matched. It is recommended to control the foreign exchange collection time within 30 days after the goods arrive at the port, to avoid tax audit triggered by "delayed foreign exchange collection".。
