I am a foreign trade factory in China specializing in hardware products, which has been supplying EU clients. In the past two years, due to EU anti-dumping duties on Chinese products and excessive tariffs, many clients have switched orders. I heard from peers that transit trade via Turkey can be used, and obtaining a Certificate of Origin from Turkey can avoid anti-dumping duties.
But I have no experience in this operation at all, do not know the compliance requirements for transit trade in Turkey, worry about cargo seizure, do not know how to meet the rules of Certificate of Origin, whether the cost will be much higher than expected, and what compliance risks there are in foreign exchange payments and receipts. I hope you can sort out the whole process and the pitfalls to pay attention to, and tell me how to conduct transit trade in Turkey in compliance.

For conducting transit trade via Turkey, the first step is to complete pre-submission document review, the core of which is to verify the qualifications of third-party transit trade partners. It is necessary not only to confirm that the other party has legitimate business qualifications, but also to confirm that they have the eligibility to apply for corresponding categories of Certificate of Origin, and also require them to provide operation records of transit trade for the same category in the past six months,so as to avoid purchasing Certificate of Origin that do not meet customs verification requirements, and proactively eliminate source risks at the document level.
The core nodes need to connect three key links: The third-party customs clearance entity must be exactly the same as the entity issuing the Certificate of Origin, which is the core standard for customs verification of origin qualification, when goods enter Turkey, they must be stored in the official supervised transit bonded warehouse, not directly departing from Turkey. The stay period must meet the minimum 3-7 days required by Turkish customs, and all supporting materials such as warehouse entry orders, warehouse exit orders, and entry/exit records must be retained throughout the process. The second core node is transportation connection: the consignee of the second bill of lading must be consistent with the transit trade partner. After completing the endorsement and transfer of the bill of lading, send it to the EU consignee, and keep records of the transfer of cargo ownership throughout the process to avoid loss of control over cargo ownership.
Prepare for emergency plans in advance, reserve a 10-day buffer period for cargo to cope with customs inspection. If the Certificate of Origin is questioned by EU customs, timely provide supporting materials such as warehouse records of Turkey transit trade and payment receipts from the manufacturer to avoid direct cargo seizure and resulting high demurrage charges.
The final compliance implementation requires completing Consistency of Four Flows: goods flow, document flow, capital flow, and invoice flow must correspond to each other. Payments and receipts must be operated through compliant channels, and complete document filing materials must be retained to meet the dual compliance requirements of the exporting country and the destination country, and successfully complete the whole process.

Turkish customs strictly review the value of Certificate of Origin for transit trade. If the difference between the domestic purchase price of transit products and the Turkish transit quotation is too large, price review disputes will be triggered. When operating, it is necessary to sort out the price logic in advance, retain domestic VAT invoices, and cost details of transit trade, including warehousing, logistics, operation and other cost details, to ensure that the price gradient meets the requirements of customs price review.
If a price review suspension has occurred, supplementary materials must be submitted within 7 working days to explain the profit addition logic of transit trade, cooperate with customs to complete the verification, and avoid the Certificate of Origin being invalidated due to failing the price review, which will ultimately affect customs clearance in the destination country. For situations that require deleting and re-submitting documents, confirm the declaration time limit requirements of Turkish customs in advance, and complete the amendment application before the seizure order is issued to reduce the risk of violation records.

The main transit ports in Turkey are Izmir and Ambarli. The free demurrage period and detention charge standards of the two ports are different. When locking transit space with shipping companies in advance, clearly apply for additional free demurrage period for transit goods. Ordinary transit goods can apply for a 7-10 day free demurrage period to avoid high detention charges and demurrage charges.
During transit operations, choose a segmented bill of lading mode: the consignee of the first bill of lading from China to Turkey is the transit trade partner, and the second bill of lading from Turkey to the destination port must be legally endorsed and transferred, and cargo ownership must be controlled throughout the process. In case of port overcapacity and cargo rejection, prepare alternative port change plans in advance, select nearby Mersin Port as an alternative transit port, to avoid shipping delays leading to client claims.

Turkey has introduced VAT exemption policies for qualified bonded transit goods, no import VAT is required, and goods can directly enter the bonded warehouse for transit without actually paying taxes. When operating, file the transit trade qualification with Turkish tax authorities in advance, apply for VAT deferral filing. If goods need to temporarily enter the Turkish domestic market before being re-exported, calculate the tax difference cost in advance, and use the domestic VAT deduction rules to reduce the overall tax burden.
It should be noted that the profit part of transit trade needs to be declared in accordance with Turkish non-resident withholding tax rules, to avoid tax penalties due to non-declaration, which will affect subsequent transit operations. Reasonable use of tax differences and exchange rate differences can reduce overall tax costs by 10%-15%.

Payments and receipts for transit trade can be completed through RMB cross-border payment CIPS channels, or through compliant offshore accounts. It is necessary to ensure that the capital flow path is consistent with the document path: domestic factory receipts correspond to domestic shipments, and transit trade partner receipts correspond to transit operations. The profit part can be retained in the transit trade partner account or remitted back to China compliantly.
If funds need to be transferred through a third-party account, complete the declaration and filing in advance to avoid triggering domestic foreign exchange verification and leading to failure of foreign exchange settlement. SWIFT messages must clearly mark "transit trade payment" to avoid banks judging the funds as unknown income and prolonging the foreign exchange settlement time. Regularly reconcile payments and receipts to ensure that each shipment corresponds to one receipt, and avoid compliance risks caused by suspended accounts.

When cooperating with Turkish transit trade partners, sign a transit agency agreement, clearly agree on the responsibility for the authenticity of the Certificate of Origin: if the Certificate of Origin is judged as non-compliant by customs, the transit trade partner shall bear corresponding losses. At the same time, agree on the time node of cargo ownership transfer, clarify the operation specifications of bill of lading endorsement, to avoid illegal occupation of cargo ownership by third parties.
For clients who pay by letter of credit (L/C), check the L/C terms in advance, exclude additional unreasonable soft clauses, and add force majeure clauses: if cargo delays occur due to changes in Turkish customs policies, exemption from liability for breach of contract. Require the transit trade partner to issue a bank guarantee to ensure the safety of funds and cargo ownership throughout the operation process.

The inspection rate of Turkish customs on transit goods is about 15%. The inspection focuses on verifying the authenticity of seals, cargo marks, and whether the cargo category is consistent with the Certificate of Origin. In advance, require the transit trade partner to check the anti-counterfeiting codes of the seals, confirm that the seals have not been replaced, and the cargo marks must clearly indicate the country of origin and transit country information, consistent with the declaration content.
If unpacking inspection is encountered, cooperate with customs to provide warehouse entry records, explain the actual situation of cargo transit, and do not provide redundant irrelevant materials to avoid misunderstandings caused by incorrect expressions. If testing and appraisal are required, prepare material composition description documents in advance, ensure consistency with the category description on the Certificate of Origin, shorten the appraisal process, and avoid additional demurrage charges.

The Mediterranean coast of Turkey has high humidity, and transit goods are prone to moisture during their stay in the warehouse. It is necessary to select moisture-proof packaging according to the cargo category: hardware products need to place sufficient desiccants in the packaging boxes, and wrap moisture-proof films on the outer layer to avoid cargo rusting during transit and affecting quality.
For transit of dangerous goods, use dangerous goods packaging that meets UN standards, complete dangerous goods classification appraisal in advance, and obtain qualified MSDS reports to ensure that the packaging meets Turkish shipping and warehousing requirements, avoiding cargo seizure due to non-compliant packaging. Ordinary goods should be packaged with reinforcement to avoid packaging loosening after unpacking inspection during transit, leading to subsequent transportation damage.

Goods exported from China to Turkey for transit can also apply for export tax rebates. When operating, it is necessary to ensure the consistency of four flows: the shipper on the domestic export declaration form, the factory invoice, the foreign exchange receipt, and the purchase contract subject must be consistent, meeting the verification requirements of tax authorities. Complete document filing in advance, retain the full set of documents for transit trade, including transit agreements, bills of lading, and copies of Certificates of Origin, for tax authority inspection.
If tax verification is encountered, timely cooperate to provide corresponding materials, explain the real background of transit trade, avoid export tax rebate failure due to non-pass of verification, and avoid unnecessary capital losses. Complete foreign exchange verification within the specified declaration period, avoid cross-month declaration affecting tax rebate eligibility.

The supply chain structure of transit trade should be adjusted according to the order volume: if long-term stable transit trade via Turkey is carried out, reserve fixed storage space in the Turkish bonded warehouse to reduce single warehousing costs, and sign long-term cooperation agreements with shipping companies to obtain more favorable sea freight prices.
Select direct transit or subsequent second voyage according to the delivery time requirements of the order: if the order delivery time is tight, select a route where the direct voyage to Turkey is followed by a direct voyage to the EU; if cost-sensitive, choose consolidated transit to reduce overall logistics costs. Combined with inventory linkage strategies, reserve some goods in the Turkish bonded warehouse in advance, ship directly after receiving orders, shorten the overall delivery cycle, improve client satisfaction, and reduce single operation fixed costs.
