I am a small and medium-sized factory exporting industrial valves. Recently, we have been supplying to EU clients. The EU imposes high anti-dumping duties on Chinese-made industrial valves, so our client requires us to conduct third-country re-export trade to reduce tax burdens.

We have no previous experience in re-export trade. We consulted several small agencies, but either their quotes are unrealistically high, or they cannot guarantee the safety of third-country cargo title. I have also heard from peers that non-compliant re-export operations were detected by the destination country’s customs, leading to the entire shipment being detained at the port.

This resulted in not only paying penalties to the client but also losing the payment for the goods. Now we want to find a reliable partner. We would like to ask about the types of agencies in the industry that handle valve re-export trade, and how to select a suitable partner for our small and medium-sized factory.

Many small agencies handling valve re-export trade have common mistakes such as forging third-country certificates of origin, failing to provide compliant endorsements for certificates of origin, directly using the headings of other goods, not retaining complete document trails for third-country transit, warehousing, and container switching, and even skipping the container switching step to cut costs, directly shipping from the original port of departure to the destination port.

The direct negative consequences of such non-compliant operations are: when the destination country’s customs launches an anti-dumping investigation,it cannot provide a matching chain of logistics, cargo title, and documents, which will directly be recognized as origin fraud, facing cargo detention, huge fines, and even the enterprise being included in the destination country’s trade blacklist. Subsequent shipments to this destination country will undergo targeted inspections, incurring additional demurrage fees, client penalties, and loss of long-term stable clients.

The core measure for physical risk isolation is: Prioritize selecting agencies with fixed third-country transit warehousing qualifications to ensure the traceability of the entire process including container switching, labeling, and certificate of origin application, with corresponding vouchers available for inspection at every step.

Exclusive loss-prevention tips: Require the agency to configure re-export trade compliance liability insurance in advance, and reserve 10% of the agency fee as a deposit,to be paid after the goods complete customs clearance in the destination country. If compliance issues arise, losses can be deducted directly from the deposit. Additionally, confirm that the agency has the ability to handle compliance defense in the destination country, and can assist in providing complete documents during inspections,so that the exporter does not need to handle the complex inspection process on its own.

For customs clearance in valve re-export trade, full sets of documents including original export declaration forms, third-country transit declaration forms, and cargo title transfer certificates must be provided in advance. The customs valuation link will focus on verifying the authenticity of third-country transit transactions. If documents do not match, it will directly be judged as incorrect declaration, leading to document backlog and failure to complete customs clearance normally.

For re-export trade valuation disputes, container switching photos, warehousing fee receipts, and third-party notarized documents must be retained in advance to cooperate with customs valuation inspections. If a document deletion and re-declaration is needed, it must be completed within 15 working days to avoid demurrage fees due to over time.

For industrial electromechanical products like valves, the transit country operation information must be clearly marked during re-export customs declaration. Hiding information related to the country of origin will be considered as non-compliant declaration, which will not only block the current shipment’s customs clearance but also affect the enterprise’s subsequent import and export customs clearance credit rating, increasing the probability of subsequent inspections.

The selection of transit routes for valve re-export trade should be comprehensively judged based on cargo volume, destination country requirements, and transit port free storage and free container periods. Do not choose small ports only based on transit costs. Many small transit ports do not have stable direct shipping schedules to the destination country, leading to container rollover and overbooking, resulting in shipping delays of 1-2 weeks and additional container demurrage fees.

During operations, confirm that the transit port has a minimum free storage period of 7 days to leave sufficient time for container switching and labeling operations. After container switching, amend the bill of lading in time and complete the bill of lading endorsement transfer to ensure smooth transfer of cargo title to the destination country’s client.

For large-sized industrial valves, reinforcement must be done during transit container switching to avoid cargo damage during transit. Also confirm that the agency has its own cooperative warehouse at the transit port, so that the progress of container switching can be tracked at any time and cargo status can be fed back in a timely manner.

The design of the tax structure for valve re-export trade should be optimized based on the transit country’s VAT policy and certificate of origin application requirements. Some transit countries allow VAT deferral, eliminating the need to pay import VAT in the transit country before applying for export tax refunds, which can reduce capital occupation costs and accelerate capital turnover.

For related-party transaction pricing of third-country transit, it must comply with BEPS transfer pricing requirements. Unreasonably low or high pricing may trigger transfer pricing investigations by the transit country or destination country’s tax authorities, leading to additional taxes and fines.

Before conducting re-export trade, calculate the tax difference benefits in advance. After deducting agency fees and transit costs, confirm that the final benefits can cover the difference in high anti-dumping tariffs to avoid ending up with negative actual benefits and wasted operation costs.

The receipt and payment of foreign exchange for valve re-export trade must comply with the foreign exchange compliance requirements of China and the transit country. Receipt and payment cannot be directly conducted between the domestic factory and the destination country’s client. Receipt and payment must be completed in line with the cargo title transfer path to ensure the matching of capital flow and cargo title flow. RMB cross-border payments via CIPS can be used for transit country settlement, which shortens settlement cycles and reduces losses from exchange rate fluctuations compared to SWIFT.

If using an offshore account to hold re-export trade funds, file the account for record in advance. Ensure that every fund inflow and outflow is supported by corresponding documents, to avoid settlement backlog and failure to complete normal settlement operations. For small and medium-sized factories, it is recommended to select an agency to assist with receipt and payment operations, as the agency’s compliance system can reduce the risk of foreign exchange receipt and payment violations.

In the contract terms of valve re-export trade, clearly define the liability division if the destination country’s customs identifies origin violations, to avoid the agency shirking responsibility after problems occur and the exporter bearing losses alone. If using letter of credit settlement, focus on reviewing the terms related to certificates of origin and bills of lading in the letter of credit.

Avoid soft clauses, and ensure that the letter of credit terms can match the document requirements of re-export operations, so that discrepancies in re-export operations do not lead to payment refusal. Require the agency to provide a bank guarantee to ensure the authenticity and validity of the certificate of origin.

If losses are caused by documents provided by the agency, the agency shall bear compensation liability in accordance with the guarantee agreement. At the same time, a formal cargo title transfer agreement must be signed in the cargo title transfer link to clarify the rights and obligations of all parties.

After container switching in the transit country for re-export trade, customs will check the authenticity of seals and cargo information. Prepare the original export packing list and invoice in advance to ensure they match the valve’s model, quantity, and declaration information. During container inspection, ensure that the cargo marks have been changed to the marks required by the transit country, without residual marks from the country of origin that may arouse customs suspicion.

If the destination country’s customs conducts on-site inspections, provide complete photos of the entire container switching process, transit warehousing fee receipts, and certificate of origin application documents to cooperate with customs inspections. If testing and appraisal are required, assist in providing the valve’s product manual and specification parameter documents to ensure that the appraisal results match the declaration information, avoiding being identified as non-compliant due to parameter inconsistencies.

The supply chain structure for valve re-export trade should be planned based on long-term order volume. If there is stable monthly valve exports to the destination country, a long-term fixed warehousing point in the transit country can be selected to reduce the cost of single transit operations.

If only occasional orders exist, shared transit warehousing resources can be chosen to reduce fixed investment. Regarding the selection of trade terms, FOB transit port terms are suitable for re-export trade, where the agency is responsible for subsequent logistics to the destination country, which can better control transit risks.

At the same time, a cost calculation model can be established, incorporating anti-dumping tax differences, agency fees, transit costs, and exchange rate fluctuations to dynamically adjust re-export operation costs and ensure that the final benefits meet expectations. For long-term re-export operations, an inventory linkage strategy can be established, storing some valves in the transit country’s warehouse in advance to allow direct shipment for urgent orders and shorten delivery cycles.
