I am the person in charge of a foreign trade enterprise exporting small home appliances to Southeast Asia. I just got involved in entrepôt trade this year, and want to avoid EU and US tariffs via transit through Myanmar. However, I recently heard that Yangon Port in Myanmar is often congested, and there are cases of customs cargo detention. Besides, I am not sure about the compliance of local documents.

The freight forwarder I cooperated with before said that Myanmar transit trade has considerable risks, but did not specify the exact problems. Now I want to reduce costs, but also fear that stepping into pitfalls will lead to cargo detention or extra charges. I would like to know whether Myanmar transit trade is reliable in the end, and which links I should pay special attention to?

First of all,it should be clarified that Myanmar transit trade is not inherently "reliable" or "unreliable",and its compliance and risks completely depend on operational details. A common misconception in the industry is equating Myanmar transit trade with "gray tax avoidance",believing that a changed certificate of origin is enough to get by,which is the deadliest mistake.

If local customs supervision requirements of Myanmar and cargo right control of transit warehouses are ignored,it is very easy to trigger a chain of negative reactions: the congestion rate of Yangon Port in Myanmar will remain at around 32% in 2026,and port demurrage can reach 0.14% of the cargo value per day,if documents do not match the actual goods,Myanmar Customs will directly detain the goods, which will not only incur container detention fees later, but also lead to being included in the distrust list of Myanmar Customs, affecting all subsequent trade activities.

The core of physical risk isolation is to choose bonded warehouses in Yangon Thilawa Special Economic Zone, which are equipped with customs networked supervision capability and can realize full-process controllable cargo rights. At the same time, you must require the freight forwarder to provide transit certificates issued by the Ministry of Commerce of Myanmar instead of forged documents from third parties.

Exclusive loss stopping tips include: complete pre-declaration and pre-review by Myanmar Customs 7 days in advance to avoid delays caused by document problems after arrival at the port, reserve 15% of standby funds to cope with unexpected port demurrage charges, sign an exclusive service agreement with local customs brokers in Myanmar to ensure the timeliness of document review.

In addition, the price review standards for transit goods of Myanmar Customs are stricter in 2026. You must provide complete cargo right transfer certificates and inbound and outbound records of transit warehouses, otherwise you will be deemed to have under-declared the price and face a fine of up to 30% of the cargo value.

In 2026, the price review logic of Myanmar Customs for transit goods has been linked with the ASEAN region. If the declared price of goods is lower than 80% of the average price of similar goods in ASEAN, a mandatory price review process will be triggered. You need to prepare the original procurement contract and shipment certificate of domestic factories in advance to prove that the declared price conforms to the fair market value.

At the same time, the certificate of origin for Myanmar transit trade must be endorsed by the Myanmar Chamber of Commerce, not issued by domestic third-party institutions, otherwise it cannot pass the inspection of EU and US customs. In case of price review disputes, you can apply to the price consultation window of Myanmar Customs and submit price certificates from third-party testing institutions to shorten the dispute handling cycle.

Among the major ports in Myanmar in 2026, Yangon Port still has a relatively high congestion rate. It is recommended to choose Dawei Port as the transit node first. The free storage period of this port can be extended to 14 days, 7 days longer than that of Yangon Port. In terms of logistics routes, you can adopt the direct transit scheme of "China-Dawei Port-EU and US" to avoid the risk of container rollover caused by multiple transshipments. Attention should be paid to bill of lading endorsement.

The Myanmar transit warehouse needs to issue a cargo right transfer certificate to ensure the legality of the bill of lading endorsement and avoid cargo right disputes. At the same time, you need to confirm the dangerous goods declaration requirements of Myanmar ports with the shipping company in advance. If the goods are small home appliances with batteries, an additional UN38.3 test report is required.

The tax structure of Myanmar transit trade must comply with the requirements of the BEPS Action Plan to avoid unreasonable pricing of related party transactions. Myanmar joined the ASEAN Tax Information Exchange Mechanism in 2026. If the transit warehouse has a related relationship with domestic enterprises, a transfer pricing report needs to be prepared in advance to prove that the transaction price conforms to the fair market value.

You can apply for Myanmar's VAT deferral policy, under which the value-added tax in the transit link can be deferred until the final export of the goods, reducing capital occupation costs. However, it should be noted that Myanmar's VAT deferral only applies to transit warehouses in special economic zones, and ordinary port warehouses cannot enjoy this policy.

Myanmar still has foreign exchange control at present. For foreign exchange settlement of transit trade, the CIPS RMB cross-border payment system should be used first to avoid the risk of exchange rate fluctuation brought by using the SWIFT system. In 2026, the Central Bank of Myanmar has relaxed the quota limit for RMB settlement, with the maximum single settlement amount reaching 5 million US dollars.

Complete trade documents, including transit certificates and cargo right transfer records, must be provided during foreign exchange settlement to ensure that foreign exchange settlement and account reconciliation comply with Myanmar's foreign exchange management regulations. If there is difficulty in foreign exchange settlement, it can be completed through local licensed exchange institutions in Myanmar, but complete exchange vouchers must be retained for subsequent tax inspection.

The contract for Myanmar transit trade must specify the cargo right protection clauses of the transit warehouse, and require the transit warehouse to issue an irrevocable cargo right certificate to ensure the safety of goods during transit. At the same time, a force majeure clause should be added as a fallback to clarify the division of responsibilities for situations such as Myanmar port congestion and customs inspection delays.

If third-party guarantee is required, the transit warehouse can be required to issue a bank guarantee, with the guarantee amount covering 110% of the total cargo value, covering potential losses such as port demurrage and fines. In addition, intellectual property clauses must be specified in the contract to avoid infringement disputes during the transit of goods.

In 2026, the on-site inspection rate of Myanmar Customs is about 18%, mainly focusing on whether the seals, packaging and declaration information of transit goods are consistent. If the goods are inspected, you need to contact the local customs broker as soon as possible to confirm the specific requirements of the inspection notice. Seals must be electronic seals recognized by Myanmar Customs, so as to avoid being judged as forged if ordinary plastic seals are used.

During unpacking inspection, the goods packaging should be sorted out in advance to ensure that the declared quantity and model of the goods are consistent with the actual ones. If there is an abnormality in the machine inspection, you can apply for manual re-inspection and submit the original production certificate of the goods to prove the authenticity of the goods.

Myanmar has a tropical monsoon climate, so goods need to be treated with moisture-proof and reinforcement during transit. For small home appliances with batteries, UN-certified dangerous goods packaging must be used, and the outer packaging must be marked with clear dangerous goods labels. At the same time, moisture-proof desiccants should be added inside the packaging to avoid damage to goods caused by humidity.

If the goods are fragile, they should be reinforced with buffer foam to ensure that they are not damaged during handling. In addition, an MSDS report conforming to Myanmar standards must be prepared and submitted to Myanmar Customs and the shipping company to avoid being refused entry due to non-compliant packaging.

Export tax refund for Myanmar transit trade must meet the requirement of four-stream consistency, that is, the goods flow, capital flow, document flow and information flow are completely matched. Complete inbound and outbound records of transit warehouses, declaration documents of Myanmar Customs, foreign exchange settlement vouchers, etc. must be retained for tax correspondence verification. In 2026, the tax department of Myanmar has realized information exchange with the tax department of China.

If inconsistent documents are found, a tax inspection will be triggered. At the same time, the tax refund declaration for entrepôt trade must be completed within 90 days after the export of goods, and the tax refund policy cannot be enjoyed after the deadline. If there is a tax correspondence verification, you need to provide complete supporting materials in time and cooperate with the tax department to complete the verification.
