I am the operator of a foreign trade enterprise mainly exporting mechanical and electrical products. This year I have tried to carry out business through agent customs declaration by a freight forwarder, and previously I handled tax refunds on my own. Now I have many confusions: First, the freight forwarder reported that there are slight differences between the cargo description on the customs declaration form and our VAT special invoice, and I am worried that this will affect the tax refund review.

Second, I heard that the joint inspection intensity of the General Administration of Customs and the State Taxation Administration will be greatly increased in 2026. I don't know how to ensure the alignment of the four streams under the agent customs declaration. Another batch of goods went through the Singapore transit port, and the freight forwarder provided house bills of lading.

I don't know if they can be used for tax refund declarations. In addition, I want to find a reliable agency, but I don't know from which dimensions to screen freight forwarders that can help us with compliant tax refunds. Can you explain in detail the entire process and precautions?

First,it is necessary to clarify that the core prerequisite for a freight forwarder engaged in agent customs declaration to participate in export tax refund is alignment of the four streams (goods flow, funds flow, document flow, contract flow),which is the core judgment standard of the 2026 joint inspection by customs and tax authorities.

In the pre-audit link, the freight forwarder needs to check in advance the consistency of the cargo description,HS code on the customs declaration form with the VAT special invoice and export sales contract, especially the model and specification parameters of mechanical and electrical products,to avoid triggering system warnings due to slight differences. Meanwhile, confirm the type of bill of lading: master bills of lading can be directly used for tax refunds, house bills of lading need to be used together with master bills, and goods transshipped at transit ports need to retain full transport documents, cannot only provide copies of house bills of lading.

In the connection of core nodes, the freight forwarder needs to synchronize the accurate electronic data of the customs declaration form to the enterprise within 3 working days after customs release. The enterprise needs to complete foreign exchange collection within 180 days after the goods are cleared, complete receipts and payments through CIPS or compliant SWIFT messages, and ensure the complete matching of funds flow and document flow. If it involves advance payment,it needs to register in advance on the foreign exchange administration platform to avoid affecting the tax refund declaration period.

For abnormal plans: If there are situations of amending customs declaration forms, deleting and re-declaring,it needs to complete data correction within 15 days after completing customs procedures and synchronize to the tax department, otherwise it will trigger tax refund suspension. If there is a tax inquiry, the freight forwarder needs to assist in providing supporting materials such as transport tracks, packing lists,third-party inspection reports, etc。to cooperate with the verification.

For final compliance implementation,it should be noted that the enterprise needs to retain the full set of documents for record-keeping,including customs declaration forms, bills of lading, foreign exchange collection vouchers, etc. Most ports nationwide have supported electronic record-keeping in 2026,which can be uploaded through the International Trade Single Window to reduce the storage pressure of paper materials, and ensure the retention period of the record-keeping documents is no less than 10 years.

The HS code and cargo name on the customs declaration form are the core basis for tax refund review. In 2026, the General Administration of Customs and the State Taxation Administration have realized real-time synchronization of customs declaration form data. Once the cargo description is inconsistent with the VAT invoice, the system will automatically trigger a warning. If there is a price review dispute, the freight forwarder needs to assist in providing materials such as transaction price certificates, third-party inspection reports to ensure that the customs declaration price is consistent with the actual transaction.

If there are situations of deleting and re-declaring, it needs to update the electronic data within 3 working days after completing customs procedures, otherwise it will affect the tax refund declaration period. In addition, when conducting agent customs declaration, it is necessary to confirm whether the freight forwarder has formal customs declaration qualifications, and confirm that its declared operating unit is completely consistent with the tax refund entity, to avoid the problem of inconsistent names. When exporting mechanical and electrical products, it is necessary to ensure that the regulatory conditions marked on the customs declaration form are consistent with the actual goods, such as the 3C certification mark, otherwise the tax authority will determine that the documents are inconsistent and reject the tax refund.

In addition, some ports have launched pre-declaration pre-audit services in 2026. The freight forwarder can submit the customs declaration form data to the customs for pre-audit in advance to correct errors in time and avoid rejection during formal declaration. When signing a cooperation agreement with the freight forwarder, it is necessary to clarify the division of responsibilities of both parties in the links of tax refund-related data transmission, document submission, etc. If the tax refund fails due to the freight forwarder's mistakes, corresponding compensation clauses need to be agreed to protect the enterprise's rights and interests.

The bill of lading is one of the core documents for tax refund. It should be noted that the consignor and consignee of the bill of lading must be completely consistent with the export sales contract and customs declaration form. House bills of lading need to be used together with master bills, and goods transshipped at transit ports need to retain full ocean bills of lading, cannot only provide house bills of lading.

The free demurrage period of major global routes has been adjusted to 7 days in 2026. If demurrage charges are incurred beyond the period, the responsible party of the charges needs to be clarified to avoid affecting document delivery due to fee disputes. In addition, for cargo ownership control, the freight forwarder is required to issue the original bill of lading in time after the goods are loaded on board, or complete endorsement through electronic bills of lading, to ensure that the enterprise can obtain the transport documents required for tax refund in time.

If there are situations of vessel rejection or route change, the customs declaration form information needs to be updated immediately to avoid tax refund review failure due to inconsistent transport tracks and customs declaration forms. The document process of direct routes is relatively simple, and transit routes need to provide additional loading and unloading certificates of transit ports to ensure the full traceability of goods transportation. The enterprise also needs to confirm whether the freight forwarder has international freight forwarding qualifications and can provide compliant transport documents, to avoid tax refund failure due to non-compliant documents.

Tax compliance is the core of the tax refund process for agent customs brokerage freight forwarders. Cross-border tax planning can be combined with the VAT deferral policy in 2026. If goods are transshipped in the EU, VAT deferral can be applied to reduce capital occupation. Meanwhile, attention should be paid to exchange rate risk. The enterprise can optimize the exchange rate through the compliant settlement channels of the freight forwarder to avoid the impact of exchange rate fluctuations on tax refund benefits.

In addition, related party transaction pricing must comply with BEPS rules. If there is a related relationship between the enterprise and the freight forwarder, a pricing document needs to be prepared in advance to avoid anti-tax avoidance investigations by the tax authority. When declaring tax refunds, attention should be paid to the foreign exchange collection time. The State Taxation Administration requires the enterprise to complete foreign exchange collection within 180 days after declaring tax refunds in 2026, otherwise an extended declaration needs to be submitted.

The freight forwarder needs to assist the enterprise in tracking the progress of foreign exchange collection to ensure compliance. The tax refund rate for export is determined according to the HS code. The tax refund rate for mechanical and electrical products is 13% in 2026. The enterprise needs to ensure that the HS code on the customs declaration form is consistent with the VAT invoice to avoid declaration errors. The retention period of record-keeping documents is 10 years, and the enterprise needs to properly keep all relevant documents for tax authority verification.

Cross-border receipts and payments compliance is a necessary condition for tax refunds. The CIPS (Cross-Border Interbank Payment System) has covered more than 100 countries and regions in 2026. The enterprise can complete foreign exchange collection through CIPS to avoid compliance risks of SWIFT messages. It should be noted that the foreign exchange collection entity must be consistent with the buyer of the export sales contract.

If there is third-party collection, a collection certificate needs to be provided, otherwise it will trigger a tax inquiry. In addition, the use of offshore accounts must comply with China's foreign exchange administration regulations. The State Administration of Foreign Exchange has strengthened the supervision of offshore accounts in 2026. The enterprise needs to ensure that the capital sources of receipts and payments are legal to avoid capital backflow.

The freight forwarder can assist the enterprise in completing settlement reconciliation and converting foreign exchange into RMB through compliant settlement channels to ensure the consistency of funds flow and document flow. When signing an export sales contract, the enterprise needs to clarify the foreign exchange collection method and time to avoid delayed foreign exchange collection. If it involves advance payment, it needs to register in advance on the foreign exchange administration platform to meet the requirements of the tax authority.

The cooperation agreement between agent customs brokerage freight forwarders needs to clarify the rights and obligations of both parties, especially the division of responsibilities related to tax refunds. It is necessary to agree that the freight forwarder must provide accurate customs declaration form data. If the tax refund fails due to the freight forwarder's mistakes, it shall bear corresponding compensation responsibilities. Meanwhile, attention should be paid to the soft terms of letters of credit.

If the buyer issues a letter of credit, it is necessary to ensure that the terms of the letter of credit are consistent with the export sales contract to avoid non-payment risks. In addition, regarding intellectual property rights, the enterprise needs to ensure that the trademarks and patents of export goods comply with the regulations of the importing country. The freight forwarder needs to assist the enterprise in completing the intellectual property customs protection filing to avoid goods seizure.

If there is a cargo ownership dispute, the freight forwarder is required to provide an LOI guarantee to ensure the safety of the enterprise's cargo ownership and avoid non-delivery of goods against original bills. When signing the contract, the enterprise needs to clarify the force majeure clause. If there are situations such as epidemics or port congestion, exemption clauses need to be agreed in the contract to avoid tax refund failure due to delayed delivery. In addition, the exclusive agreement needs to clarify the cooperation period and service scope to avoid disputes.

Customs on-site inspection is an important link in the tax refund review. The General Administration of Customs adopts the mode of machine inspection plus manual inspection in 2026. If the goods are inspected, the seal must be intact, and on-site photos need to be retained when unpacking to ensure that the goods are consistent with the customs declaration form.

If testing is required, the freight forwarder is required to assist the enterprise in completing the testing process, obtain the test report, and use the report as supporting material for tax refund. In addition, the inspection notice needs to be transmitted to the enterprise in time to ensure that the enterprise can complete rectification within the specified time. If the inspection result is inconsistent with the customs declaration form, the customs declaration form data needs to be modified in time to avoid affecting the tax refund declaration.

If the inspection delays the loading time of the goods, the tax refund declaration time needs to be adjusted in time to avoid overdue declaration. The enterprise can require the freight forwarder to select an appropriate machine inspection channel to reduce the probability of unpacking inspection. Meanwhile, attention should be paid to the authenticity identification of the seal, confirm that the seal is recognized by the customs, to avoid fake seals leading to goods seizure.

Export tax refund audit is the final link of the tax refund process. The tax authority has strengthened the intensity of inquiries in 2026. If the enterprise's tax refund declaration triggers an inquiry, the freight forwarder needs to assist the enterprise in providing supporting materials such as transport tracks, packing lists, foreign exchange collection vouchers to ensure the alignment of the four streams.

The record-keeping documents include customs declaration forms, bills of lading, export sales contracts, VAT special invoices, etc. Most ports have realized electronic record-keeping in 2026, and the enterprise can upload them through the Single Window to reduce the storage pressure of paper materials. In addition, cross-monthly declared tax refunds need to pay attention to the declaration period. The enterprise needs to complete the tax refund declaration within the VAT declaration period of the next month after the goods are cleared.

If it is overdue, an extended declaration application needs to be submitted. The capital backflow problem needs to be noted in the tax refund audit. If there is capital backflow, a reasonable explanation needs to be provided, otherwise it will be identified as tax fraud. The enterprise needs to complete pre-declaration verification before formal declaration to ensure that the data is correct and avoid errors in formal declaration.
