I am in the clothing foreign trade business. This year, I just partnered with an agency to export to Europe, and the customs declaration has now been issued. However, our finance department asked me who is responsible for tax declaration in agency exports. I heard from peers that some are declared by the agency, some by oneself, and I'm a bit confused.

The amount of our shipment is not large, but it involves tax refund. Will an incorrect declaration affect subsequent tax refunds? Also, are there any new policy changes in 2026? For example, is it now mandatory for the entrusting party to apply for tax refund by themselves?

The agency said they can act as an agent for declaration, but we need to provide all documents. I am worried that once we provide them, all responsibilities will fall on our side? Please help me sort out this issue, and it would be best to talk about the specific responsibility division and operation process. Thank you!

The core logic of agency export tax declaration in 2026 is to first clarify that the 'title of customs declaration' is the primary basis for judgment. If the operating unit on the customs declaration is the agency, then the agency is the tax refund application subject,if it is the entrusting party, the entrusting party declares on its own,and the agent only provides auxiliary services such as customs declaration data.

Pre-document review needs attention: The entrusting party must provide a special VAT invoice (the invoicing time must be within 120 days before and after the export date on the customs declaration, and the latest 2026 policy has extended this period to 120 days),export cargo loading order, bill of lading copy, etc. The agent must verify whether the product name, quantity and unit on the invoice are completely consistent with those on the customs declaration, which is the basis for tax refund.

Core node connection: After the customs declaration is cleared, the agent must synchronize the electronic data of the customs declaration to the entrusting party within 7 working days (or directly import it into the tax refund system),if the agent applies for declaration,it must complete the pre-declaration before the 15th day of the next month of the export date on the customs declaration, and the entrusting party must cooperate to provide the electronic receipt of foreign exchange collection (paper foreign exchange verification documents have been abolished in 2026).

Exception plan: If there is a discrepancy between the product name on the invoice and that on the customs declaration,an application for deleting and re-declaring the customs declaration must be submitted before the customs declaration modification deadline (within 30 days after clearance),otherwise, tax refund cannot be obtained. If the system prompts 'incomplete documents' when the agent declares, immediately check whether the loading order or bill of lading is missing to avoid overdue declaration.

Final compliance implementation: No matter who applies for declaration, the 'consistency of four flows' must be ensured—contract flow (entrustment agency agreement),invoice flow (issued by the entrusting party to the agent or by itself),capital flow (payment by the agent to the entrusting party or foreign exchange collection by the entrusting party itself),and cargo flow (the consignor on the bill of lading corresponds to the entrusting party. Tax letter inquiry has been electronic in 2026,and all documents must be retained in advance for inspection.

The operating unit column of the customs declaration in 2026 is the key to determining the tax declaration subject. If the operating unit is the agency, it needs to declare exports to the customs in its own name.

Meanwhile, the agent must transmit the electronic base account of the customs declaration (via the Single Window) to the entrusting party within 10 working days after declaration. It should be noted that if the entrusting party requires the operating unit on the customs declaration to be itself, it must provide the business license, record form of foreign trade operator, etc. to the agent in advance, and the consignor on the customs declaration must be consistent with the entrusting party; otherwise, the consistency verification of subsequent tax refund declaration will be affected.

In addition, the customs has realized automatic connection between customs declaration and tax refund system in 2026. If the operating unit is inconsistent with the tax refund application subject, the system will automatically alarm, and a written explanation must be submitted within 3 working days to avoid being listed as an abnormal enterprise.

The subject of VAT and consumption tax refund for agency exports in 2026 depends on the agreement between the entrusting party and the agent and the title of the customs declaration. If the agent is a general taxpayer and the operating unit on the customs declaration is the agent, the agent can apply for tax refund to the tax authority, but the entrusting party must provide the special VAT invoice (the deduction copy must be handed over to the agent within 30 days after certification).

If the entrusting party applies for declaration on its own, it must complete the application before April 30 of the next year of the export date on the customs declaration, and must provide the 'Certificate of Agency Exported Goods' issued by the agent (an electronic certificate in 2026, no need for paper). It should be noted that a new 'agency export tax refund risk assessment' has been added in 2026. If the agent has overdue tax refund records in the past 2 years, the entrusting party shall apply for declaration on its own to reduce risks, and avoid the agent occupying the entrusting party's funds through tax refund funds.

The foreign exchange collection and payment for agency exports in 2026 are directly related to the tax declaration subject. If the agent is the tax refund subject, it must collect foreign exchange in its own name (must be consistent with the amount on the customs declaration, with an error of no more than 5%), and must pay the payment to the entrusting party within 10 working days after foreign exchange collection (must provide the corresponding invoice).

If the entrusting party applies for declaration on its own, it must collect foreign exchange in its own name, and the agent is only responsible for customs declaration and logistics. It should be noted that the CIPS system has covered all agency export businesses in 2026. Foreign exchange collection must be settled via CIPS to avoid tax risks caused by foreign exchange collection through offshore accounts.

In addition, if the agent fails to pay the entrusting party in time after foreign exchange collection, it will be listed as 'fund detention' by the foreign exchange administration, which will affect subsequent business of both parties. The time node of payment after foreign exchange collection must be clearly stipulated in the agreement (it is recommended not to exceed 7 working days).

The document record requirements for export tax refund in 2026 have been updated. No matter who applies for declaration, the following documents must be retained: entrustment agency agreement, customs declaration copy, special VAT invoice deduction copy, electronic foreign exchange receipt, loading order, bill of lading.

If the agent applies for declaration, these documents must be scanned and uploaded to the tax refund system, and the entrusting party must retain the paper version for inspection (at least 5 years). It should be noted that if the documents for record-keeping are incomplete, the tax authority will suspend the tax refund and may impose a fine of less than 10% of the tax refund amount.

In addition, tax letter inquiry has realized 'intelligent comparison' in 2026. If the product code on the invoice is inconsistent with that on the customs declaration, the letter inquiry will be directly triggered, and supporting materials must be provided within 15 working days; otherwise, the tax refund will be rejected.

During on-site customs inspection in 2026, if the operating unit on the customs declaration is the agent, the agent must provide the electronic authorization of the entrusting party, and verify whether the product name and quantity are consistent with those on the customs declaration during inspection. If there is a discrepancy, the agent or the entrusting party will be required to provide a written explanation. If it cannot be provided, the customs declaration clearance will be affected, leading to a delay in tax refund declaration.

It should be noted that if the goods are dangerous goods, the agent must provide the electronic MSDS in advance; otherwise, the inspection will require inspection, and if the inspection time exceeds 10 days, the customs declaration clearance will be delayed, making tax refund declaration impossible. In addition, if the seal is damaged during inspection, the agent must contact the customs to re-seal immediately to avoid affecting the transfer of cargo rights, thereby affecting foreign exchange collection and tax refund.

The selection of tax declaration subject for agency exports in 2026 should be combined with supply chain cost optimization. If the entrusting party is a small-scale taxpayer and cannot deduct input tax, it is recommended that the agent (a general taxpayer) apply for tax refund, which can enjoy export exemption and tax refund.

If the entrusting party is a general taxpayer and has the ability to apply for tax refund by itself, applying on its own can avoid the tax refund service fee charged by the agent (the market service fee is about 1%-3% of the tax refund amount in 2026). In addition, if the export destination is an RCEP member state, the RCEP Certificate of Origin in 2026 can be superimposed with tax refund preferences.

The agent should help handle the Certificate of Origin at the same time, and ensure that the product code on the customs declaration is consistent with that on the Certificate of Origin to avoid affecting dual preferences. It should be noted that if the agent is selected to apply for declaration, the distribution method after tax refund arrival must be clearly stipulated in the supply chain agreement to avoid capital disputes.
