I am a foreign trade factory that exports small household items. We recently switched to self-operated exports and for the first time hired an agent to handle export tax refunds.

Previously, I heard from peers that some agents require the bill of lading, while others do not seem to. This batch of goods is shipped to the customer by air, and since the customer needs it for customs clearance at the destination, the original bill of lading has already been sent to the customer, and now I only have the scanned copy in hand.

I am now worried that if the agent insists on the original bill of lading for tax refund processing, and I cannot provide the original copy, it will prevent me from completing the process, affect the progress of my tax refund, and even lead to the failure of the tax refund. Is there any alternative solution? I want to clarify whether the agent needs the bill of lading for export tax refund regardless of whether it is by sea or air, and what the requirements are in different situations.

A common misconception in the industry is that agents handling export tax refunds must provide the original ocean bill of lading. Many enterprises go to great lengths to retrieve the original bill of lading to meet this requirement, and even some unethical institutions mislead enterprises into forging and retaining the bill of lading, which in turn creates compliance risks.

If you blindly operate according to the wrong requirements,it will trigger a series of negative consequences: retrieving the original bill of lading will delay the customer's customs clearance, leading to customer complaints and even breach of contract claims, forging or modifying bill of lading information will be directly judged as non-compliant documents during tax authority document verification or inquiry,at the minimum resulting in a delay of several months in the tax refund process, and at the maximum leading to the direct rejection of the tax refund, and the enterprise will also be included in the key monitoring list for export tax refunds, with every subsequent export tax refund subject to stricter scrutiny, which may even affect the enterprise's import and export customs declaration qualifications.

The effective risk isolation measures are clear: An agent handling export tax refunds only requires a copy or electronic scan of the bill of lading for document filing, and there is no need to retain the original bill of lading. Whether exported by sea,air or express, only a clear electronic copy of the corresponding transportation document is required. The original can be directly sent to the customer for destination customs clearance without returning.

If no electronic copy of the bill of lading is retained, the exclusive stop-loss measure is: You can provide a combination of three documents: booking confirmation, freight payment voucher, and trailer transportation documents, explain the situation to the agency and the competent tax authority in advance for filing, and then you can normally process the tax refund without affecting the tax refund progress and qualifications.

The transportation information of exported goods during the customs declaration process has been synchronized to the customs and tax authorities through the manifest transmission system. The bill of lading itself only serves as a supporting document to verify the consistency of the transportation logic of exported goods. When handling export tax refunds through an agent, only need the consignee, quantity of goods, port of loading and port of destination information on the bill of lading to be consistent with the information on the customs declaration form, without requiring the original bill of lading for verification.

If there is a discrepancy between the bill of lading information and the customs declaration form, timely cancellation and re-declaration or modification of the bill of lading information is required to maintain data logic consistency, avoid triggering system alerts due to information verification failure, and leading to the suspension of the tax refund process. For LCL shipments, providing a copy of the master bill of lading for LCL plus a scan of the house bill of lading is sufficient, no additional supporting materials are required.

Different transportation methods and bill of lading forms have no difference in document requirements, and the original is not required. If it is a telex release bill of lading, in the absence of a paper original, providing a scan of the telex release notice screenshot and telex release guarantee is sufficient for document filing. If the bill of lading has been endorsed and transferred, only need to provide a clear scan of the endorsed copy, without returning the original bill of lading.

For FBA head haul or cross-border e-commerce bulk cargo shipments, freight forwarders often do not issue original bills of lading to save processes, so providing a scan of the house bill of lading issued by the freight forwarder plus the freight invoice can meet the requirements and will not affect the processing of export tax refunds through agents. For shipments that have been rejected by the carrier or rerouted and re-billed, provide scans of both the old and new bills of lading, clearly marking the changes.

When tax authorities review export tax refunds, the core role of the bill of lading is to prove the authenticity of the export business, and the core verification points are the consistency of the bill of lading information with the customs declaration form, foreign exchange collection vouchers, and purchase and sales contracts. The original bill of lading will not be required for verification. As long as the core data of all documents match and can prove the existence of a real business, it meets the tax requirements for tax refunds.

If the enterprise cannot provide the bill of lading for special reasons, a combination of corresponding transportation invoices, booking vouchers, and insurance policies can also prove the authenticity of the business, will not affect the review and arrival of tax refunds, and will not additionally increase the enterprise's tax cost. There is no need to pay extra demurrage or express fees to obtain the original bill of lading.

During the foreign exchange receipt and payment compliance review process, only need to verify that the consignee information on the bill of lading is consistent with the counterparty information on the trade contract and foreign exchange receipt and payment vouchers. The original bill of lading will not be required for verification.

Whether it is SWIFT USD settlement or CIPS RMB cross-border settlement, only the logical consistency of the bill of lading information is required, and no paper original needs to be retained. If it is a business handled via offshore accounts, as long as the bill of lading information is consistent with the contract information, the scan will meet the compliance verification requirements, will not be judged as non-compliant for foreign exchange receipts and payments due to the absence of the original bill of lading, will not affect the settlement and matching processes, and no notarization or authentication procedures for the original bill of lading need to be processed.

The original bill of lading is itself a document of title for taking delivery of goods at the destination port. Once it is handed over to the agency for retention, it will affect the customer's normal customs clearance and goods taking at the destination port, and easily lead to breach of the trade contract and generate unnecessary legal disputes.

Handling export tax refunds through an agent does not require occupying the original bill of lading, only a scan or copy with complete information is needed, which will not affect the transfer of title and will not change the title delivery terms agreed in the original trade contract. If an agency requests you to retain the original bill of lading for tax refund processing, you must refuse. This operation is not only unnecessary, but also increases the risk of title disputes and does not comply with international trade delivery rules.

During the on-site inspection at the export port, the customs verifies the goods information, container seal information, and electronic data in the manifest system, and will not require presenting the original bill of lading for verification. The scan of the bill of lading with consistent information with the manifest electronic data meets the requirements for tax refund document retention.

If a discrepancy between the quantity of goods information and the bill of lading is found during the inspection, timely provide the correct scan of the bill of lading and explain the situation, no original is required. The authenticity of the seal is also verified through the system's seal number, and there is no need to verify through the original bill of lading. As long as the seal number on the scan is consistent with the system, there will be no problem.

Currently, export tax refunds have fully implemented electronic document filing. All filing documents only need to be uploaded as clear electronic versions, and there is no need to mail paper originals to agencies or tax authorities, including the bill of lading. The core of document filing review is the consistency of the four streams, that is, the core information of the bill of lading is consistent with the customs declaration form, purchase and sales contract, and foreign exchange collection vouchers.

The original bill of lading is not required for verification. For old businesses that apply for tax refunds retroactively, only a scan of the bill of lading is needed to complete the filing, no need to retrieve the original bill of lading. If the original has already been sent to the customer, you only need to ask the customer to provide a clear scan to meet the requirements, no need to return it to China.

Multi-batch and small-batch exports have become the mainstream mode of foreign trade today. Most transportation uses telex release bills of lading to simplify processes, no need to issue original bills of lading. The rules for agency-based export tax refunds have also been adapted to this mainstream mode, and only electronic bills of lading are needed for processing, will not affect the tax refund process, and no need to adjust trade terms or supply chain processes for tax refunds.

Regardless of whether it is FOB or CIF terms, whether it is the buyer-designated freight forwarder or the seller's own booking, only need to provide the electronic version of the corresponding bill of lading, no additional adjustments to supply chain arrangements, will not increase the operation cost of the supply chain, and can maintain the efficiency of the existing process.
