I am the person in charge of an industrial and trading enterprise engaged in home appliance exports in the Pearl River Delta. Last year, the EU imposed an additional 47% anti-dumping duty on our flagship electric water heater products, directly eroding the profits of the long-term contracts we had negotiated and forcing us to pay liquidated damages to customers. Recently, some peers said we can transship through Malaysia and evade anti-dumping duties by changing local certificates of origin, with an additional cost of only about 2%—which would still leave a profit.
However, I previously saw news that some enterprises were investigated by customs for entrepot trade, convicted of the crime of smuggling general goods, not only having to pay several times the tax supplement but also the person in charge bearing criminal liability. Now I have 12 containers of EU orders waiting to be shipped at the end of the month. I want to ask: is entrepot trade illegal? What conditions are required for compliant operations? Will it affect my previous normal customs declaration orders?

The biggest cognitive misunderstanding many enterprises have about entrepot trade is equating it with "forged certificates of origin" or "gray customs clearance". In fact, legal entrepot trade is a conventional international trade form that does not touch legal red lines, only non-compliant operations will trigger legal risks. If false certificates of origin, forged logistics tracks,or fictional trade backgrounds are used in operations, the destination country’s customs will first detain and return the goods, and the enterprise will be listed in trade credit blacklists of economies such as the EU,making all products unable to enter local markets for 3-5 years. After being verified by domestic customs,it will be judged as smuggling general goods. In addition to paying back the full amount of taxes,a fine of 0.5 to 5 times the tax amount will be imposed. If the amount involved exceeds 100,000 RMB,relevant persons in charge will bear criminal liability.
To achieve compliance in entrepot trade, first ensure that goods must actually enter the supervisory area of the transit country for delivery,do not only do "documentary entrepot trade". After the goods arrive at the transit port, the whole process of bonded warehouse warehousing, repacking, labeling, and secondary outbound must be completed, and all port payment receipts, warehouse receipts, loading and unloading certificates, and logistics track data must be retained. Secondly, certificates of origin must be issued truthfully by official institutions of the transit country. To obtain a certificate of origin from the transit country, the local value-added standard for origin must be met,do not buy fake certificates with money. Finally, the whole-chain documents must be retained for at least 5 years for future reference, including domestic purchase contracts, transit country trade contracts, logistics documents, and foreign exchange settlement and payment vouchers, ensuring the alignment of the four streams.
If you have previously operated suspected non-compliant entrepot orders, immediately sort out all retained documents. If there is no false content, file a record retroactively,if there are defects, actively explain the situation to the local customs for lighter handling. Conduct compliance pre-examinations for all subsequent entrepot orders to avoid affecting normal customs declaration businesses.

In 2026, the key points of customs valuation for entrepot trade mainly focus on three dimensions. First, the authenticity of the transit country’s trade: customs will compare manifest data of the transit port and in/out data of bonded warehouses to verify whether the goods have actually been delivered in the transit country. "Empty transit" without actual entry and exit records will be directly judged as false trade.
Second, the authenticity verification of certificates of origin: currently, customs have realized networked verification with origin management systems of more than 120 countries worldwide. Fake certificates of origin will be identified within 24 hours after submission, directly triggering control inspection. Third, price rationality: the pricing of entrepot trade must comply with the arm’s length principle.
The prices of goods sold from domestic subjects to transit country subjects and from transit country subjects to destination country subjects shall not deviate from the average market price of the same period by more than 10%, otherwise the valuation procedure will be initiated, requiring submission of pricing explanations. If no explanation can be provided, the dutiable value will be adjusted and corresponding tariffs and value-added tax will be required to be paid.

The logistics chain of entrepot trade must be traceable. First, choose direct-transit routes to avoid ports of high-risk sensitive countries. Currently, in 2026, Port Klang in Southeast Asia, Port of Singapore, and Jebel Ali Port in the Middle East are mature ports for entrepot operations, with an average transit time of 3-7 days and free detention periods that can be extended to 14 days, greatly reducing container detention costs.
After the goods arrive at the transit port, complete repacking operations, replace the seals of the transit country, completely remove the origin marks on the original packaging, and replace them with marks of the transit country. All repacking photos and seal number records shall be retained and archived.
The bill of lading shall be endorsed and transferred twice: first, endorsed by the domestic shipper to the transit country’s trade subject, then by the transit country’s subject to the destination country’s consignee. The whole process of cargo right transfer records shall be clear to avoid cargo right disputes and provide core evidence for trade authenticity.

Tax compliance for entrepot trade should focus on two levels. First, domestic tax declaration: the price difference income from entrepot trade belongs to cross-border service income. The policy in 2026 allows zero value-added tax (VAT) preference, provided that complete documents of entrepot trade are retained and submitted to tax authorities for review during declaration.
Failure to declare as required will be treated as domestic sales and subject to 13% VAT. Second, tax costs of the transit country: withholding tax rates vary greatly among different transit countries. Malaysia’s withholding tax rate for entrepot trade is 0; Singapore’s profits from entrepot trade can enjoy a preferential tax rate of 10% if eligible.
Choose an appropriate transit country according to the origin standard of the product to avoid additional tax costs. In addition, pay attention to the pricing rationality of related-party transactions: the transaction pricing between domestic subjects and transit country subjects must comply with the arm’s length principle to avoid being initiated anti-avoidance investigations by tax authorities and adjustment of taxable income.

Foreign exchange settlement and payment for entrepot trade shall follow the corresponding principle of "receive before pay" or "pay before receive". In 2026, the key points of foreign exchange bureau’s verification for foreign exchange settlement and payment of entrepot trade are the matching degree of capital flow and cargo flow: each foreign exchange receipt shall correspond to the cargo transportation track and trade contract one by one; multiple funds shall not be mixed for settlement and payment. If receiving foreign exchange through an offshore account, complete SWIFT message records shall be retained.
The funds can only be used to pay domestic purchase prices and logistics costs at transit ports, and cannot be transferred to personal accounts at will, otherwise it will trigger anti-money laundering warnings of banks and the account will be frozen. Currently, when handling foreign exchange settlement and payment of entrepot trade through the Cross-Border Interbank Payment System (CIPS), the review timeliness is about 30% faster than SWIFT, and it can also avoid exchange rate fluctuation risks. It is suitable for entrepot orders with an amount of more than 1 million RMB. When settling and paying, clearly mark "entrepot trade proceeds" in the remarks for bank review.

Relevant clauses on responsibility division shall be set in entrepot trade contracts. First, in the agreement with transit country service providers, clearly stipulate the responsibility for the authenticity of certificates of origin: if detainment, fines, or criminal liability are caused by fake certificates of origin, they shall be fully borne by the transit service provider; at the same time, agree on liquidated damages, with a ratio of not less than 20% of the order value, to reduce their own risks.
Second, in the contract with destination country customers, clearly stipulate the bearing subject of anti-dumping duties: if compliance issues are caused by customers requiring entrepot trade, customers shall bear joint and several liability. In addition, pay attention to intellectual property risks: if the product has registered trademarks in the transit country or destination country, obtain authorization from the trademark right holder before entrepot trade to avoid being detained by customs and even triggering intellectual property infringement lawsuits, with compensation usually reaching 1-3 times the cargo value.

If the goods have not actually gone through customs declaration for departure and entered the bonded regulatory area of domestic customs, they cannot enjoy export tax rebate policies. Only when the goods actually depart to the transit country and meet other conditions for export tax rebate can they declare for export tax rebate. In 2026, the tax authorities’ key points for rebate verification of entrepot trade are the consistency of the four streams: the complete matching of cargo flow, capital flow, document flow, and information flow. Any defect in any link will trigger tax correspondence investigation, requiring submission of complete documents of entrepot trade.
If unable to provide, the already rebated tax shall be recovered, and a fine of 0.5 to 3 times the tax amount shall also be imposed. In addition, the documents of entrepot trade shall be retained for at least 10 years for future reference, including export customs declarations, warehouse receipts of transit ports, logistics documents, trade contracts, foreign exchange settlement and payment vouchers, and certificates of origin, to avoid being unable to provide supporting materials during subsequent verifications and being identified as tax fraud.
