I run a cross-border small commodity export business. Recently, I have not received foreign exchange for nearly two months for a batch of goods due to the overseas customer's payment issues, but the customs declaration form and all tax refund documents for this batch are fully prepared. I heard that foreign exchange collection is a must for tax refund.

If the foreign exchange can never be collected, does that mean I cannot apply for this tax refund at all? Will there be other compliance problems? I am very anxious now, and I would like to know if there are special circumstances that allow tax refund handling without foreign exchange collection, or any urgent remedial solutions available.

According to the latest 2026 compliance requirements for cross-border export tax refund, full foreign exchange collection is not the only mandatory precondition for export tax refund, but specific compliant document rules need to be met. First of all,we sort out the special recognized circumstances for foreign exchange collection: cases of cross-border settlement between RCEP member states, deferred foreign exchange collection filed with tax authorities, and inability to collect foreign exchange caused by force majeure such as overseas bankruptcy, can all be classified into the scope of deemed foreign exchange collection.

For pre-submission document review, you need to keep the full set of customs declaration forms, commercial invoices, bills of lading, foreign exchange settlement slips (or supporting documents for deemed foreign exchange collection) and trade contracts. The four-flow consistency rule still needs to be followed, but the foreign exchange collection time does not have to be completely synchronized with other procedures. At the core procedure node, you should submit the List of Causes and Supporting Documents for Deemed Foreign Exchange Collection within the tax refund declaration period, instead of waiting for the foreign exchange to arrive in the account before submitting the declaration.

For abnormal contingency plans,if you still have not collected the foreign exchange after the declaration period expires, you can supplement and submit the deemed foreign exchange certification materials within the VAT declaration period of April in the following year, and no additional late payment penalty is required. If the overseas customer defaults on payment, you can use the compensation letter issued by export credit insurance as an alternative document to complete the tax refund declaration.

For final compliance implementation, you need to ensure the authenticity and relevance of all documents to avoid risks related to false foreign exchange collection. Meanwhile, pay attention to the integrated cross-border tax refund system launched at Shanghai Port in 2026,where you can submit deemed foreign exchange applications online to shorten the review cycle.

The foreign exchange collection column on the customs declaration form shall be filled in compliance with the 2026 customs declaration specifications. For deemed foreign exchange collection scenarios, you shall mark the words "deemed foreign exchange collection" in the "Other Remarks" column of the customs declaration form to avoid the document being returned during review.

In the price verification process, you need to ensure that the transaction price of the goods meets customs requirements. If delayed foreign exchange collection affects price confirmation, you can provide the deferred payment clause in the trade contract as supplementary explanation, no adjustment to the declared customs price is needed.

The endorsement and transfer of the bill of lading shall match the trade settlement method. If you adopt a usance letter of credit or collection settlement method, the consignee field on the bill of lading can be filled in "to order", which does not bind the procedure to the foreign exchange collection time.

Pay attention to the rules for using free detention period: if goods are stranded due to foreign exchange collection problems, you can apply to the shipping company in advance to extend the free detention period to avoid container demurrage, and keep all relevant communication records as auxiliary documents for tax refund.

For cross-border exports to RCEP member states, you are eligible for the VAT deferral policy, which means no VAT is payable at the import link. The deferred VAT can be used to offset domestic value-added tax, indirectly reducing export costs.

Please note that the VAT deferral policy only applies to transactions with RCEP member states, and you need to submit the VAT deferral filing form required by the tax authority. This procedure can be carried out synchronously with the export tax refund declaration without adding extra procedures.

The foreign exchange settlement and account reconciliation for offshore accounts shall comply with the latest 2026 regulations of the State Administration of Foreign Exchange. For deemed foreign exchange collection scenarios, you can handle foreign exchange settlement and account reconciliation with the deemed foreign exchange collection certificate issued by the tax authority, no actual foreign exchange collection slip is required.

Using the CIPS cross-border RMB payment system can speed up the arrival of collected funds. For customers with delayed payment, you can suggest adopting RMB settlement to reduce exchange rate fluctuation risks.

The force majeure clause in the trade contract shall clearly cover circumstances that lead to uncollectible foreign exchange, such as overseas customer bankruptcy and epidemic outbreaks. If such situations occur, the certificate issued by the local chamber of commerce or the local Chinese embassy/consulate can be used as valid basis for deemed foreign exchange collection recognition.

You shall review soft clauses in the letter of credit in advance to avoid clauses stating that "the letter of credit shall not take effect until foreign exchange is received", and you can revise the letter of credit clauses to add the exception for "deemed foreign exchange collection".

If on-site cargo inspection is required, you need to ensure that the consignee information on the inspection record is consistent with the information on the trade contract and bill of lading, to avoid tax refund being blocked due to mismatched information.

The photos taken during machine inspection shall clearly show the outer packaging of the goods and the seal number. If the seal is damaged leading to uncollectible foreign exchange, you can provide the seal damage certificate issued by the shipping company as supplementary material for deemed foreign exchange collection recognition.

Consistency of four flows (capital flow, goods flow, invoice flow, contract flow) is the core requirement for tax refund. Under deemed foreign exchange collection scenarios, you shall ensure that the alternative documents for capital flow (such as the credit insurance compensation letter) match the information of the other three flows, to avoid information inconsistency.

Pre-declaration verification shall be completed before the formal tax refund declaration, the system will automatically verify the relevance of all documents. If any problem is detected, you can make adjustments in time to avoid rejection of the formal declaration.
