I am the head of a small foreign trade company. I recently exported a batch of electronic products to Europe through a freight forwarder agency. Previously, we handled export tax refunds on our own.
After commissioning the freight forwarder this time, the finance department mentioned that the tax refund process might change, and there are concerns that the agency arrangement might prevent us from getting the refund. Our goods have been declared for export, but the foreign exchange has not yet fully arrived, and documents are being organized.
I want to know if we can actually get a tax refund for export via freight forwarder agency? What materials need to be prepared? Are there any hidden risks to watch out for?

Whether a tax refund is available for export via freight forwarder agency depends on whether the basic conditions and operational standards for tax refunds are met. First,it must be confirmed that the freight forwarder has legal agency qualifications and that the export business is genuine and valid.
In the preliminary document review stage,it is necessary to ensure consistency of the four flows: actual export of goods (corresponding to the bill of lading and customs declaration form),invoice issuance (the title of the VAT special invoice must match the exporting enterprise),capital return (foreign exchange credited to the exporting enterprise's account),and contract signing (trade contract between the exporting enterprise and the foreign merchant). The freight forwarder must provide a "Certificate of Agency Export Goods." This certificate must be applied for and issued by the freight forwarder to its competent tax authority within 30 days after the customs declaration of export.
Regarding the connection of core nodes, the exporting enterprise must submit tax refund declaration materials to the competent tax authority within 90 days from the date of customs declaration of export. These materials include the customs declaration form, certificate of agency export,VAT special invoice, and foreign exchange collection voucher, etc. If the collection of foreign exchange is delayed,an application for extension of declaration must be made within the prescribed period to avoid tax refund failure due to expiration.
In terms of contingency plans,if documents are missing or information does not match, communicate with the freight forwarder immediately for rectification,if encountering a tax inquiry letter, cooperate by providing genuine business materials to ensure the inquiry is passed. For final compliance implementation, attention must be paid to the completeness of document filing, including the bill of lading, contract, packing list, etc。which must be kept for at least 5 years.

From a customs declaration perspective, the key to tax refunds for freight forwarder agency exports lies in the accuracy of the customs declaration form information. The "Domestic Goods Source" on the customs declaration form must be consistent with the location of the issuer of the VAT invoice, and the "Trade Mode" must be "General Trade" or other modes that meet tax refund conditions.
If the customs declaration information is incorrect, an application for modification must be made to Customs before the tax refund declaration; otherwise, the tax refund review will not pass. In addition, the "Operating Unit" on the customs declaration form must be the exporting enterprise itself, and the freight forwarder, acting as the "Declaring Unit," must be filled in correctly to avoid a mismatch of the tax refund subject caused by an incorrect operating unit.

From a tax planning perspective, under the freight forwarder agency export model, the exporting enterprise needs to focus on the integrity of the VAT special invoice deduction chain. If the services provided by the freight forwarder involve agency customs declaration or transportation, the VAT special invoices they issue can be used for input deduction, but it must be ensured that the invoice content matches the actual business.
At the same time, attention must be paid to the applicable tax refund rate; different goods have different refund rates, which need to be queried accurately based on the commodity code to avoid calculation deviations in the refund amount due to rate errors. Additionally, if the exporting enterprise is a small-scale enterprise, it may enjoy policies for a simplified tax refund process, and eligibility should be confirmed in advance.

In the tax refund audit stage, the focus is on on verifying the consistency of the four flows. The capital return must match the declared amount; if there is an exchange rate difference, a reasonable explanation must be provided. The invoice content must be consistent with the declared commodity name and quantity; the contract must clearly define the rights and obligations of both trading parties to avoid ambiguous clauses.
Furthermore, documents must be stored as required and be available promptly during an audit. If there are anomalies in capital return (such as third-party payment), relevant supporting materials must be provided to prove the business is genuine and legal; otherwise, it will be identified as a risk of false invoicing or tax fraud.

From the perspective of foreign exchange compliance, when exporting via freight forwarder agency, foreign exchange must be remitted directly to the exporting enterprise's account and must not pass through the freight forwarder's account (unless stipulated by a legal agency agreement).
If an offshore account is used for collection, it is necessary to ensure that the account information is truthfully filled in during the tax refund declaration, and the collection time must be within 180 days from the date of customs declaration of export (extension can be applied for in special cases). Additionally, when using CIPS for cross-border RMB payments, the payment voucher must be retained as part of the collection proof to ensure the completeness of the tax refund declaration materials.

From a legal perspective, commissioning a freight forwarder for export agency requires a clear agency agreement. The agreement must stipulate the obligations of the freight forwarder, including the timely issuance of the certificate of agency export and assistance in handling tax refund-related procedures. If the freight forwarder fails to fulfill its obligations resulting in a tax refund failure, the exporting enterprise may hold them liable for breach of contract according to the agreement.
In addition, attention must be paid to whether the Letter of Credit (L/C) contains soft clauses that affect tax refunds, such as requiring the freight forwarder to hold title to the goods or designating a specific freight forwarder. It is necessary to ensure that such clauses do not affect the exporting enterprise's qualification as the tax refund subject.

From a supply chain planning perspective, under the freight forwarder agency export model, the efficiency of document circulation needs to be optimized. It is recommended to establish a real-time communication mechanism with the freight forwarder to ensure the timely transmission of documents such as customs declaration forms and bills of lading, avoiding overdue tax refund declarations due to document delays.
At the same time, consider integrating the freight forwarder into the supply chain management system to enhance the transparency of the tax refund process through data sharing and reduce operational risks. Additionally, partnering with a freight forwarder with rich experience in tax refunds can reduce refund issues caused by non-standard operations.
