I am a local Taizhou foreign trade merchant engaged in small and medium-sized auto parts exports. Recently, I encountered anti-dumping tariff barriers when supplying to the US market.

My peers say that entrepot trade can reasonably avoid high tariffs, so I am interested. However, I have never operated entrepot trade before and have no idea about the compliant and feasible types of international entrepot trade in Taizhou, or which types are suitable for small and medium-sized businesses like us with small order volumes and limited working capital.

I am afraid that choosing the wrong type will either lead to non-compliance and customs seizure, or be too costly to make a profit. Therefore, I want to know clearly what the entry requirements and applicable scenarios of different entrepot types are, so that I can choose the right operation method.

Currently, the feasible international entrepot trade types in Taizhou are mainly divided into three categories: traditional entrepot, bonded entrepot, and third-country entrepot. The cost structure and applicable scenarios of these three modes vary greatly. The traditional entrepot mode requires the goods to actually enter the domestic port before being reboxed and re-exported. It not only requires advance payment of import deposit and import value-added tax but also occupies additional port storage and working capital. For small and medium-sized businesses with small order volumes and limited working capital,it is difficult to bear the additional capital cost pressure.

Bonded entrepot is carried out relying on the bonded logistics centers and bonded port areas in the Yangtze River Delta region. Goods directly enter the bonded supervision area for storage and transshipment, without entering the domestic tax area throughout the process. No import value-added tax is required, and only a small amount of storage and operation fees need to be paid. It is suitable for multi-batch small and medium-sized orders that need to be resold to multiple overseas buyers in a short period of time.

Third-country entrepot is mainly used to avoid trade barriers in the destination country. By reboxing in transshipment countries such as ASEAN and Mexico, and issuing a certificate of origin before sending to the destination country,it can use the tax difference dividend of the transshipment country to reduce the destination country's tariffs. The entry threshold only requires advance docking with compliant freight forwarders and customs clearance resources in the transshipment country. It is suitable for a large number of auto parts and mechanical and electrical export orders in Taizhou that target the US and European markets and are subject to anti-dumping restrictions.

The benefits of different modes will change dynamically according to the order size and the destination country's tariff policy. Before operation,it is necessary to conduct a profit ratio forecast for specific orders, match the most suitable mode, avoid unnecessary cost expenditures, and ensure compliant business implementation.

Different entrepot trade types correspond to different customs declaration requirements. Traditional entrepot requires separate import and export declarations. When declaring, complete proof of goods ownership, purchase and sales contracts, and invoices need to be provided.

The price assessment link will check the pricing rationality of the two transactions to avoid price assessment disputes caused by abnormal pricing. Bonded entrepot only requires the declaration of the inbound and outbound filing list, without formal customs declaration and tax payment. When declaring, the purpose of entrepot trade needs to be clearly marked to avoid being identified as general trade import.

When third-country entrepot is shipped through Taizhou port, the transshipment route must be truthfully declared, and the actual situation of third-country entrepot must not be concealed; otherwise, it will be regarded as false declaration, affecting the enterprise's customs credit rating. All entrepot trade declarations need to keep complete document records to deal with subsequent customs inspections.

Different entrepot trade types have different logistics routes and goods ownership control requirements. Traditional entrepot requires arranging unpacking and reboxing at Taizhou Port for re-shipment. It is necessary to communicate port change information with the shipping company in advance and reserve sufficient free storage and container periods to avoid high container detention fees and port detention fees.

Bonded entrepot goods directly enter the bonded logistics center without unpacking or reboxing. Only goods ownership registration needs to be done, and the bill of lading can be directly endorsed and transferred to complete the goods ownership transfer.

When third-country entrepot is shipped through Taizhou, the consignee on the bill of lading should be the cooperative freight forwarder in the transshipment country to avoid discrepancies found during the destination country's customs inspection of the origin. Reboxing should choose compliant port service providers in the transshipment country, and seal monitoring should be done throughout the process to avoid loss or tampering of goods.

Different entrepot trade types have quite different tax treatment methods. For traditional entrepot, goods enter the country and then are re-exported. Export tax rebates can be applied for in accordance with regulations, but the requirement of consistency of four flows (capital flow, goods flow, invoice flow, and contract flow) must be met, and the capital flow and goods flow must be completely matched.

Bonded entrepot goods do not enter the domestic tax area, so no import value-added tax is required, nor is export tax rebate involved. Only the entrepot trade income needs to be truthfully declared during the enterprise income tax final settlement.

If third-country entrepot is only shipped through Taizhou port and the goods do not enter the country, it can be handled as offshore trade. VAT deferral rules can be used to reduce capital occupation, and tax differences between different countries can be reasonably used to optimize overall profits. Tax structure planning needs to be done in advance to avoid cross-border tax risks.

The compliance requirements for collection and payment of entrepot trade vary according to the type. Traditional entrepot trade can directly complete collection and payment through domestic current account, and complete purchase and sales contracts and bill of lading records need to be kept to cooperate with the bank for collection and payment verification.

Collection and payment of bonded entrepot trade can be handled according to offshore trade rules, and the Cross-border Interbank Payment System (CIPS) can be used for settlement to reduce losses caused by exchange rate fluctuations. For third-country entrepot trade, attention should be paid to the consistency of the collection and payment path and the transaction path.

The payment can be directly made from the final destination country or transferred through the middleman in the transshipment country. Complete transaction chain supporting materials need to be retained to avoid being identified as abnormal foreign exchange settlement, which affects the enterprise's foreign exchange collection and payment quota.

The contract terms of different entrepot trade types need to be adjusted accordingly. For third-country entrepot trade, the goods ownership responsibilities of all parties in the transshipment process should be clearly defined in the contract, and the responsibility for the validity of the certificate of origin should be agreed upon to avoid the buyer's refusal to pay due to the certificate of origin issued by the transshipment country not meeting the requirements of the destination country.

For traditional entrepot trade, the responsibility for goods damage in the reboxing and storage links should be clearly agreed, and the obligations of all parties should be clearly divided. For bonded entrepot trade, the node of goods ownership transfer should be clearly defined in the contract, corresponding to the process requirements of bill of lading endorsement and transfer. It is recommended to add a force majeure clause to deal with emergencies such as port congestion and policy changes, and protect the rights and interests of all parties.

The key points for on-site inspection response of different entrepot trade types are different. When traditional entrepot goods are inspected upon entry, complete purchase and sales contracts, invoices, and proof of goods ownership need to be prepared in advance, cooperate with the customs to check the goods information, and explain the purpose of entrepot trade to avoid being identified as illegal import.

Bonded entrepot goods are inspected in the bonded supervision area. It is necessary to cooperate with the customs in advance to prepare for the goods to be transferred out for inspection, check the integrity of the seal, and ensure that the goods information is consistent with the declared information.

When third-country entrepot is inspected for shipment through Taizhou port, the final flow direction and transshipment route of the goods should be truthfully explained, and corresponding transaction supporting materials should be provided. The fact of transshipment must not be concealed to avoid being identified as false declaration leading to goods detention.
