I am the person in charge of a small and medium-sized enterprise engaged in the export of household goods in the Yangtze River Delta region. This year, we have just increased our shipment volume to the European market.

Last month, we entrusted three different freight forwarders to handle four full-container load (FCL) sea shipments, and the tax rates on the agency service invoices we received were surprisingly different: some were 6% VAT special invoices, some were tax-exempt ordinary invoices, and one small-scale taxpayer issued a 3% ordinary invoice. Our finance department did not pay much attention to this before. When conducting quarterly tax accounting recently, we found that the input tax deduction and cost accounting for this part were in a mess.

We are worried that incorrect handling will affect the subsequent export tax refund declaration and even trigger tax warnings. We want to clarify what the applicable tax rates for export sea freight agency are under the current policies in 2026, what the applicable conditions for different tax rates are, and how we, as the entrusting party, can judge the compliance of the tax rates on invoices issued by freight forwarders.

Many foreign trade enterprises have unclear understanding of tax rate rules when accounting for sea freight agency costs. Either they receive non-compliant invoices by mistake, leading to input tax reversal and payment of back taxes and late fees,or they fail to actively match the optimal tax rate plan, unnecessarily increasing logistics costs by 1-5%.

Under the current valid policies for 2026,first,the basic tax rates for different taxpayer entities are clarified: General taxpayers providing purely domestic supporting agency services for export sea freight (including domestic trucking, customs declaration, port miscellaneous fee handling and other services not connected to international transportation links) apply a 6% VAT rate, and can issue VAT special invoices for the entrusting party to deduct input tax. If the freight forwarder's services cover international segment sea freight agency and directly settles international segment freight with international transportation enterprises, the entire agency service is eligible for VAT exemption and only VAT ordinary invoices can be issued. Small-scale taxpayers providing export sea freight agency services apply a basic 3% levy rate regardless of business type, and can directly issue tax-exempt ordinary invoices if their cumulative quarterly invoiced amount does not exceed 300,000 yuan.

The core criteria for judging the applicability of tax rates are whether the freight forwarder's service scope includes international segment agency and whether it has completed tax exemption filing. You may request the freight forwarder to provide tax exemption filing documents to verify its invoicing qualification. If your enterprise's exported goods are eligible for tax refund (exemption) policies and you do not need to deduct input tax for sea freight agency, you can prioritize freight forwarders that can issue tax-exempt invoices, which can reduce the corresponding agency service fees by 2-4 percentage points. If the exported goods are subject to the policy of being taxed as domestic sales,it is more cost-effective to request 6% VAT special invoices to deduct input tax.

It should be noted that you shall not require a freight forwarder that has completed tax exemption filing to issue special invoices for international segment agency business. Otherwise, the other party will have to waive its tax exemption qualification for 36 months, and both parties will trigger tax compliance warnings.

The invoicing tax rate for export sea freight agency fees directly affects the customs' price assessment of the CIF transaction value of exported goods. If the freight forwarder issues a combined tax-exempt invoice for international segment tax-exempt agency fees and domestic segment taxable agency fees, and you declare the export at FOB price, customs will require you to split out the international segment freight amount and deduct it from the transaction value during price assessment. If you cannot provide clear expense splitting vouchers, customs will adjust the dutiable value, either requiring you to pay additional export duties or affecting the tax base for export tax refunds.

You shall require the freight forwarder to issue separate invoices for domestic segment taxable services and international segment tax-exempt services when invoicing, and mark the corresponding export declaration form number in the remarks column to facilitate subsequent customs inspection and export tax refund document filing. If you have already received a combined tax-exempt invoice, you may request the freight forwarder to re-issue separate invoices to avoid disputes in subsequent price assessment.

The application of tax rates for export sea freight agency is directly related to the actual delivery nodes of logistics services. If the freight forwarder provides door-to-port services, the delivery nodes for domestic segment services such as trucking, warehousing, and port miscellaneous fees are at the gate of the domestic port. This part of the services falls within the taxable scope and applies a 6% tax rate.

The part of the international segment sea freight service delivered after departure from the domestic port can be included in the tax-exempt scope. If the freight forwarder issues a tax-exempt invoice for the entire service, you shall require it to provide manifest information and transportation contracts for the corresponding route, clearly marking the expense splitting ratio between the domestic and international segments, to avoid disputes over the tax base corresponding to expense claims in case of abnormal situations such as container rejection or port change. Meanwhile, tax-exempt international segment agency fees cannot be included in the insured value base to avoid overpaying insurance premiums.

The tax exemption policy for export sea freight agency falls under the category of cross-border service tax exemption. There is no need to file for zero tax rate; only the service contract, qualification certificate of the international transportation service provider, and international segment freight settlement vouchers need to be retained for future reference. If your enterprise is a group-type foreign trade enterprise, you can incorporate the entire chain of sea freight agency services into the tax-exempt scope by establishing your own freight forwarding company, which can save 6% of VAT costs annually.

Meanwhile, you can retain profits in the freight forwarding company that meets the preferential income tax conditions for small and micro enterprises through related-party transaction pricing, further reducing the comprehensive tax burden. It should be noted that related-party transaction pricing must comply with the arm's length principle, and the pricing fluctuation ratio shall not exceed 10% of the industry average level to avoid being identified as profit transfer by tax authorities and triggering anti-tax avoidance investigations.

The invoicing tax rate for export sea freight agency directly affects the verification logic of cross-border payment and receipt. If the freight forwarder issues a tax-exempt invoice for international segment agency services, the corresponding payment can be made directly under the service trade category without providing a customs declaration form; only the agency contract and invoice are required to process the payment.

If a 6% taxable agency invoice is issued, and the corresponding fees are for domestic segment services, settlement can only be made in RMB, and foreign exchange purchase for payment is prohibited. Otherwise, it will be identified as illegal payment by the foreign exchange administration and trigger foreign exchange inspection.

You shall clearly agree on the settlement currency corresponding to the invoice type before signing the contract with the freight forwarder to avoid payment bottlenecks that may affect the freight forwarder's document release timeliness. Meanwhile, the payment records of tax-exempt agency fees do not need to be included in the deduction scope of export receipt verification and will not affect your enterprise's export tax refund qualification.

When signing an export sea freight agency contract, it is necessary to clearly agree on the tax rate type and invoicing requirements of the invoice to avoid fee disputes caused by tax rate disputes later. If the contract stipulates a tax-inclusive price and does not clearly specify the tax rate, and the freight forwarder issues a tax-exempt invoice, you have the right to require it to calculate and deduct the corresponding tax at the 6% tax rate before paying the agency fee.

Similar disputes in judicial practice basically support the claims of the entrusting party. Meanwhile, it is necessary to clearly stipulate in the contract that if the invoice issued by the freight forwarder does not meet tax compliance requirements, resulting in losses such as back tax payment, late fees, and fines for your enterprise, all losses shall be borne by the freight forwarder, and you have the right to pursue corresponding breach of contract liability. The penalty ratio can be set at 1.2 times the loss amount to cover the cost of capital occupation.

During on-site port inspection, if customs requires you to provide vouchers for sea freight agency fees, an inconsistent invoicing tax rate will directly trigger an upgrade of the targeted inspection. If the freight forwarder issues a 6% taxable invoice for international segment tax-exempt fees, customs will suspect that you are disguising the cost of domestically purchased goods as sea freight agency fees and underreporting the export value, and will require container unloading to verify the actual value of the goods, resulting in additional container unloading fees, port detention fees, and shipping schedule delays.

After receiving the freight forwarder's invoice, you shall check it against the transaction method on the export declaration form immediately. If you declare at FOB price, the corresponding international segment freight invoice must be a tax-exempt invoice, and domestic segment port miscellaneous fees can be recorded based on taxable invoices. Organize the corresponding vouchers and include them in the customs declaration documents, so they can be submitted directly during inspection to speed up the inspection and release process.

If your exported goods are dangerous goods, and the corresponding sea freight agency services include special services such as dangerous goods packaging inspection and dangerous goods declaration handling, this part of the services falls within the scope of taxable technical services, cannot be included in the international segment tax-exempt agency scope, and needs to be invoiced separately at a 6% tax rate.

If the freight forwarder combines this part of the fees into the international segment agency fees and issues a tax-exempt invoice, during subsequent port inspection, if it is found that the dangerous goods declaration fees are not taxed separately, you will be required to pay the corresponding back taxes, and the release timeliness of dangerous goods will also be affected, resulting in shipping schedule delays. You may require the freight forwarder to separately list the fee items and corresponding tax rates for dangerous goods special services when invoicing, and issue separate invoices from ordinary agency fees to avoid subsequent compliance risks.

The invoice type of export sea freight agency directly affects the compliance of document filing for export tax refunds. If your exported goods are eligible for the VAT exemption, credit and refund policy, and you obtain a VAT special invoice for the corresponding international segment sea freight agency fees, you cannot deduct the input tax.

If you have already deducted it, you need to reverse the input tax. Otherwise, you will be identified by tax authorities as fraudulently obtaining input tax deduction, and the refunded taxes will be recovered, along with a fine of 0.5 to 5 times the amount. After receiving the freight forwarder's invoice, your finance department shall distinguish between taxable and tax-exempt items immediately.

Among taxable items, only agency fees used for domestic sales goods can be deducted as input tax; input tax for agency fees used for export tax-exempt or refund items must be reversed. Meanwhile, all sea freight agency invoices shall be bound together with the corresponding customs declaration forms and agency contracts for future reference, with a retention period of 10 years, and shall not be destroyed without authorization.

Optimizing the tax rate application plan for export sea freight agency can help you reduce the overall logistics costs by 3-5%. You can choose the corresponding freight forwarder invoicing plan according to different trade terms.

If the transaction is based on EXW or FOB, prioritize freight forwarders that can issue tax-exempt invoices for international segment agency services, and entrust domestic segment agency services to local small freight forwarding companies separately to enjoy the 3% levy rate preferential policy for small-scale taxpayers. The comprehensive cost is about 2 percentage points lower than entrusting a large freight forwarder with the entire service.

If the transaction is based on CIF or CFR, you can split the international segment freight and agency fees: pay the freight directly to the shipping company and the agency fees to the freight forwarder, who only issues a tax-exempt invoice for the agency service fees, which can further reduce costs. After making a precise calculation based on your annual shipment volume, you can choose the optimal cooperation mode.
